Title:KAZNOVALNE ODŠKODNINE - PUNITIVE DAMAGES V SLOVENSKEM PRAVU - BOLJŠA GENERALNA PREVENCIJA PRED PREPREČEVANJEM POVZROČANJA ŠKODE

Abstract:V svojem diplomskem delu sem se ukvarjal z problematiko odškodnin v slovenskem pravosodnem sistemu, še posebej pa z določanjem njihove višine. Predvsem so me zanimale civilne kazni (punitive damages), torej visoke odškodnine v civilnem pravu, katerih začetki temeljijo v anglosaških pravnih sistemih. Skozi njihovo analizo sem poiskal argumente za in proti, najbolj pa sem se osredotočil na generalno prevencijo pred preprečevanjem povzročanja škode. Poiskal sem primere iz prakse, tudi tuje. V izpostavljenih primerih iz prakse sem pokazal, da so odgovorni za škodo morali plačati visoko civilno kazen in potem posledico, ki je sledila. Navedel sem tudi primere, v katerih so proizvajalci sami v strahu pred visokimi odškodninami sami umaknili potencialno nevaren proizvod. Civilne kazni imajo tako generalno preventivni kot tudi specialno preventivni namen. V svojem delu sem se predvsem ukvarjal z generalno preventivnim, vendar pa sta oba povezana, zato se delo v določeni meri navezuje tudi na specialno preventivnega. Na kratko sem predstavil primerjalno ureditev odškodninskega prava v angleškem, francoskem in nemškem pravnem sistemu. Sistemi so si nekoliko različni, tako da slepo kopiranje rešitev iz tujih sistemov v slovenskega ni mogoč. Ukvarjal sem se tudi z argumenti za in proti uvedbi kaznovalni odškodnin v slovenski pravni red. Slepo sledenje ameriškemu načinu dosojanja visokih odškodnin ni smiselno, popolno omejevanje oz. preprečevanje dosojanja kaznovalnih odškodnin pa po mojem mnenju tudi ni dobro. Uravnotežena srednja pot bi bila primerna.

Title:PUNITIVE DAMAGES IN SLOVENIAN LAW - BETTER GENERAL PREVENTION BEFORE CAUSING DAMAGE
Abstract:In my thesis i was dealing with the issue of compensation in slovenian law system, specially the determination of their amount. First of all i was interrested in civil penalties (punitive damages), therefore heavy damages in civil law, whose origins are based in the Anglo-Saxon legal systems. Through their analysis, I find the arguments for and against, most of all, I have focused on general prevention against prevention of harm. I found examples from practice, including foreign. In this cases I demonstrate when those responsible for harm, they must pay a heawy civil penalty and then the result that followed. I have also noted cases in which the producers themselves in fear of high compensation withdrew themselves potentially dangerous product. Civil penalties also have a general preventive as well as special preventive purpose. In my thesis I mainly deal with general, preventive. But they are both connected, so this work is to some extent also related to special preventive. Briefly I presented comparative regulation of tort law in English, French and German legal system. Systems are slightly different so blindly copying the solution from foreign systems in Slovenian is not possible. I also looked at the arguments for and against the imposition of punitive damages in the Slovenian legal system. Blindly tracking the American way of awarding high compensation is not reasonable. Complete containment or. prevention of awarding punitive damages in my opinion is not good. A balanced middle path would be suitable.
