Title:POSEGANJE NA NARAVNE VIRE ZARADI EKONOMSKE (FINANČNE) ODVISNOSTI DRŽAVE

Abstract:Skupne dobrine človeštva in njihova dostopnost do dobrin, s katerimi človeštvo zadovoljuje svoje potrebe je neločljivo povezano z vprašanjem njihovega lastništva in odgovornosti zanje. V prvem odstavku 19. členu Stvarnega zakonika je zapisano, da je javno dobro stvar, ki jo v skladu z njenim namenom ob enakih pogojih lahko uporablja vsakdo (splošna raba). Ta odstavek si ljudje razlagajo po svoje in v njem vidijo le koristi, ki jim pripradajo in nikakor ne tudi obveznosti. Čeprav zakon omogoča uporabo javnega dobra vsakomur, pod enakimi pogoji, ne smemo pozabiti, da smo omejeni z zakoni narave. Pretirana uporaba in brezskrbno ravnanje nas lahko pripelje do izgube, katero škodo bomo občutili šele kasneje. Pomembno je, da se do javnega dobra obnašamo kot do svoje lastnine, da z njim ravnamo bolj skrbno in ga previdno uporabljamo. Stari Rimljani so poznali tri vrste lastnine: res privatae (privatna lastnina), res publicae (javne stavbe, ceste in podobno) in res communes (darovi narave, ki pripadajo vsem). Prvi dve lastnini poznamo še danes, medtem ko smo na tretjo že skoraj pozabili in jo vse bolj zanemarjamo, uničujemo in brezobzirno izkoriščamo. Izkoriščanju so podvrženi predvsem tisti naravni viri, ki omogočajo ustvaranje dobička. Venadar se prav zaradi dobička, veliko zasebnikov zanima za nemoten dostop uporabe teh naravnih virov in prilastitev dobička. Ker je dobiček njihov edini cilj, se ponavadi dajatve za surovino naravnega vira povečajo in s tem lahko povečujejo revščino v državi, če si lokalno prebivalstvo teh dajatev ne more privoščiti. Največji problemi so predvsem z vodo, ki predstavlja osnovi vir za preživetje in je v nekaterih državah še vedno problem njene dostopnosti. Izkoriščanje in poseganje na naravne vire mora biti čim bolj pametno in preudarno, saj poznamo tudi neobnovljive naravne vire in njihovo uničenje bi lahko povzročilo veliko škodo vsem živim bitjem (ne samo ljudem).

Title:ENCROACHMENT ON NATURAL RESOURCES BECAUSE OF ECONOMIC (FINANCIAL) DEPENDENCE ON THE STATE
Abstract:Common goods of humanity and their access to the resources with which mankind meets their needs is inextricably linked to the question of their ownership of and responsibility for them. In the first paragraph of Article 19 of the Stvarni zakonik states that the public good is thing that in accordance with its intended purpose under the same conditions can be used by anyone (general use). This paragraph makes people interpret in their own way and see it as a benefit belongs to them and no obligations. Although the law allows the use of a public good for everyone under the same conditions, we must not forget that we are limited by the laws of nature. Excessive use and hassle-free handling can lead us to losses, which will be felt later. It is important to behave like as the public good is in our property in order to treat them more carefully and cautiously used. The ancient Romans were familiar with the three types of property: really privatae (private property), really publicae (public buildings, roads, etc.) and really communes (the gifts of nature, which belong to everyone). The first two property we know it today, while a third is almost forgotten and increasingly neglected, and destroying ruthlessly exploited. Exploitation they are subjected mainly those natural resources that allow generate profit welfare state. But also for profit, many private interest in the uninterrupted access use of these natural resources and the appropriation of profits. Because profit is their only goal, they tend increase charges for natural resource and this may lead to increasing poverty in the country, if the population are depending of these benefits and can not afford them. Such problems are especially water, which represents the basis for survival and in some countries there is still problem of its availability. Exploitation and encroachment on natural resources must be as wise and prudent, because there are also non-renewable natural resources and their destruction could cause a lot of damage to all living beings (not just people).
