Abstract:	Pravica stvarnega bremena je pravica stvarnega prava, ki kot stvarna pravica na tuji stvari, po svoji vsebini pomeni omejitev temeljne lastninske pravice. Kot institut stvarnopravnega podroc?ja, je del splos?nega civilnega prava, ki ureja razmerja med subjekti glede objektov ter del premoz?enjskega prava, ki se ukvarja s poloz?ajem stvarnih pravic. Imetnik pravice stvarnega bremena, ki predstavlja eno izmed oblastvenih pravic na stvari, nima vseobsez?ne oblasti, ampak je njegov poloz?aj determiniran s predpisi iz zadevnega podroc?ja. Diplomska naloga se poleg vsebine instituta, osredotoc?a ravno na ta poloz?aj, na meje dovoljenega izvrs?evanja pravice ter na uc?inek pravice nasproti tretjim.

Title:	ENCUMBRANCE
Abstract:	The definition of an encumbrance is a burden, obstruction or impediment on property that lessens its value or renders it unmarketable. As an institute of property law, it is part of a general civil law that governs relationships among entities concerning facilities. It is also a very important part of property law that deals with the situation of a real property rights not only concerning the owner, but outside forces as well. In fact, an encumbrance is typically in the right or interest of someone other than the owner of the estate that may include an easement on the property. The holder of an encumbrance does not have an all encompassing authority, but rather applicable regulations of a determined authority, which makes it rely much on the law. This thesis focuses not only on the contents of the this institute of property law, but also on the rights to exercise limits and the effect of these rights against third parties.
