Title:NADOMESTNO MATERINSTVO IN PRIMER TAJSKEGA DEČKA GAMMYJA

Abstract:Diplomsko delo obravnava institut nadomestnega materinstva, pri katerem se nadomestna mati s pogodbo zaveže, da bo za bodoči par bodisi odplačno (komercialno nadomestno materinstvo), bodisi neodplačno (altruistično oz. nekomercialno nadomestno materinstvo) donosila otroka, ter ga po rojstvu tudi trajno izročila sopogodbenikoma. Slovenska zakonodaja nadomestnega materinstva zaenkrat še ne dopušča, tako sklenjene pogodbe pa bi bile nične. Diplomsko delo se dotika tudi problematike nadomestnega materinstva, primera tajske nadomestne matere, ki je rodila dvojčka za avstralski par, katerega slednji dečka po imenu Gammy zaradi downovega sindroma in srčne napake zavrnil in pustil pri nadomestni materi. Bralec se skozi diplomsko delo seznani tudi s postopki oploditve z biomedicinsko pomočjo, ki se redno izvaja pri nadomestnem materinstvu. Do oploditve nadomestne matere lahko pride na razne načine, največ tako rojenih otrok pa je spočetih s postopkom znotrajtelesne oploditve z umetno osemenitvijo oz. in vivo fertilizacijo in in vitro fertilizacijo oz. postopkom zunajtelesne oploditve. Tako rojen otrok je lahko genetsko in gestacijsko otrok nadomestne matere, kar poznamo pod izrazom tradicionalno nadomestno materinstvo, nasprotno pa se pri gestacijskem nadomestnem materinstvu uporabijo spolne celice partnerjev, ki so tako rekoč »naročili« otroka pri nadomestni materi. V diplomskem delu je podrobneje predstavljena pravna ureditev nadomestnega materinstva v Avstraliji, prav tako pa tudi v Sloveniji, pri čemer je naša zakonodaja glede tega zelo skromna. Med drugim so predstavljeni tudi nekateri izmed mednarodnih virov, ki bodisi posredno ali neposredno urejajo nadomestno materinstvo.

Title:SURROGACY AND THE SURROGACY CASE OF THAI BABY GAMMY
Abstract:The diploma paper discusses the legal institution of surrogacy. The surrogate mother signs a binding contract, in which she agrees to carry and deliver a child for the future parents, either for payment (commercial surrogacy) or without any financial gain (altruistic surrogacy). After the birth the surrogate mother is bound to hand over the baby to her contractual partners. Slovene legislation does not currently permit any form of surrogacy. Therefore, from a legal standpoint, such agreements and contracts would be considered as null and void. The diploma paper addresses the problematic of surrogacy, and the case of a Thai surrogate mother, who delivered twins for an Australian couple. The couple refused to take both babies. The baby named Gammy was diagnosed with Down’s syndrome and heart defect, which is why the couple left him with the surrogate mother. The reader can gather information about different insemination procedures, which are a frequent part of the surrogacy process. Insemination of the surrogate mother can be done in several different ways. Most of the children are conceived with the process of intra uterine insemination (IUI) or the in vivo fertilization, or with the help of an in vitro fertilization (IVF) that takes place “outside the body, in a glass”. Newborns that are the genetic and gestational children of the surrogate are a part of so called traditional surrogacy. In other cases – gestational surrogacy – both the eggs and the sperm come from the couple who have paid for the pregnancy. The diploma paper represents the legal regime of surrogacy in Australia as well as in Slovenia. Wherein, the Slovene legislation on the subject of surrogacy is very scarce. Amongst others, the paper also includes international sources which either directly or indirectly regulate surrogacy.
