Title:STEKI KAZNIVIH DEJANJ V ZAPRTIH PROSTORIH ŽRTVE

Abstract:Na splošno velja, da je lahko neko kaznivo dejanje izvršeno z enim storilčevim dejanjem, zaradi česar se posledično (če so za to izpolnjene materialne in procesne predpostavke) proti njem vodi sodni postopek. Prav tako pa lahko storilec z enim samim dejanjem izpolni zakonske znake več kaznivih dejanj (t. i. idealni stek kaznivih dejanj), oziroma izpolni zakonske znake več kaznivih dejanj v okoliščinah, zaradi katerih je potrebno, da se proti storilcu vodi enotni postopek ter izreče enotna kazen (t. i. realni stek kaznivih dejanj). Diplomsko delo povzema splošne značilnosti stekov kaznivih dejanj, njihovo umestitev v pravni sistem, ter njihov odnos do sorodnih pravnih institutov. Skladno z izbranim naslovom je poudarek dan predvsem razmeroma slabo raziskanemu področju situacij in primerov, v katerih se stek kaznivih dejanj izvrši v zaprtih prostorih žrtve, kot so na primer stanovanje, hotelska soba, počitniška hišica, itd.. V uvodnem diplomskega dela je na kratko s kriminološkega gledišča predstavljena kategorija kaznivega dejanja ter poleg nje kategoriji žrtve in storilca kaznivega dejanja, kot elementa, ki sta nujno potrebna pri vsakem kaznivem dejanju. V nadaljevanju diplomsko delo podrobneje razčlenja in shematsko prikazuje členitev stekov kaznivih dejanj, kot posebne, sui generis pojavne oblike kaznivih dejanj. Poleg tega opredeljuje kategorijo žrtvinih zaprtih prostorov, kot kraja izvršitve kaznivih dejanj, ki so bistveni predmet diplomskega dela. V osrednjem delu diplomskega dela je pozornost namenjena specifični pojavni obliki stekov kaznivih dejanj, natančneje primerom, ko so-le ti izvršeni v žrtvinih zaprtih prostorih, ter analizi, kako in zakaj se takšni primeri razlikujejo od klasičnih stekov kaznivih dejanj. Diplomsko delo obravnava tudi vprašanje, zakaj je zakonodajalec uzakonil nekatere nekonsistentnosti glede inkriminacije določenih kombinacij kaznivih dejanj, za katere je značilno, da do njih redoma prihaja v žrtvinih zaprtih prostorih. Izpelje določene ugotovitve in zaključke, zakaj je zakonodajalec posebej inkriminiral kombinacijo protipravnega vstopa in tatvine, ne pa drugih tovrstnih kombinacij kaznivih dejanj. V zaključnem delu pa diplomsko delo skozi načelo prepovedi ponovnega sojenja obravnava še način odmere in izreka kazenske sankcije storilcu kaznivih dejanj v steku, ter primerja ureditev tematike stekov oz. ekvivalentnih institutov v nekaterih drugih (tujih) pravnih redih.

Title:CONCURRENCE OF OFFENSES ON THE VICTIM´S PREMISES
Abstract:It can be said that a criminal offense may be committed in one of two ways. Either the offender’s single act violates a single statutory provision, for which the offender then answers before a court of law or in such a way that a single act committed by the offender actually violates several statutory provisions or the provisions of several different statutes simultaneously. This dissertation effectively summarizes general characteristics of cases in which there exists a concurrence of several offenses, the installation of such cases into the criminal legal system and explores their relationship to other similar legal institutes. In accordance with the chosen title and topic, special attention and emphasis are given to the relatively sparsely researched and regulated field of study of concurrence of offenses in which the offender commits said offenses on the victim’s premises. In the introductory part of this dissertation some attention is given to the definition and analysis of the terms victim and culprit of a criminal offense from a criminological viewpoint, as the two basic legal categories necessary for a criminal offense. The dissertation then proceeds to shed light on the structure and subdivision of concurrence of criminal offenses as a unique, sui generis criminal category. It further proceeds to analyze the category of victims’ premises, as the site where the concurrence of offenses the dissertation is concerned with is committed. In the central segment the dissertation then sets its’ focus upon the specifics of cases in which the concurrence of offenses is committed on the victims’ premises as well as the analysis of the why and how such cases differ from the general norm. It touches upon the question of why the legislative body has permitted certain inconsistencies in the incrimination of combinations of certain offenses which commonly occur on the victim’s premises. The dissertation proceeds to extrapolate certain conclusions regarding why the legislative body felt the need to specifically incriminate of combination of breaking-and-entering and theft, and not the need to incriminate other, similar combinations of offenses using the same method. In its’ final segments the dissertation proceeds to describe the methods and procedure the courts use in determining the sentence of a offender who has committed such offenses, as well as to analyze and compare concurrence of offenses and other similar criminal constructs in several different legal systems.
