Title:PRAVNI INTERES ''CONDICTIO SINE QUA NON'' UGOTOVITVENE TOŽBE

Abstract:Tožba je tožnikova zahteva za pravno varstvo, s katero se začne pravdni postopek. Da je tožba dopustna, morajo biti izpolnjene procesne predpostavke. Procesna predpostavka v pravdnem postopku pomeni okoliščino ali lastnost, ki mora biti ali ne sme biti podana, da je sojenje dopustno. Glede na vsebino pravnega varstva, ki ga tožnik zahteva, in glede na vsebino tožbenih zahtevkov razlikujemo med dajatveno (kondemnatorno), ugotovitveno (deklaratorno) in oblikovalno (konstitutivno) tožbo. Pri dajatveni in oblikovalni tožbi se obstoj procesnih predpostavk predpostavlja in jih ni potrebno posebej dokazovati, pri ugotovitveni tožbi pa se njihov obstoj ne predvideva. Za ugotovitveno tožbo je nujen obstoj procesnih predpostavk. Odsotnost katere od njih pomeni, da sodišče tožbe ne začne obravnavati z vsebinskega vidika (meritorno). Interesi za vložitev tožbe so različni in odvisni od tožnikov, vendar pa mora biti za ugotovitveno tožbo nujno podan pravni interes. Pravni interes je eno izmed temeljnih načel civilnega pravdnega postopka. Kot procesna predpostavka za dopustnost ugotovitvene tožbe od tožnika zahteva, da le ta izkaže, da je njegov pravni položaj ogrožen zaradi določene negotovosti glede pravnega razmerja in da je prav ugotovitvena tožba najbolj primerno pravno sredstvo za odpravo te negotovosti. Prav tako od tožnika zahteva, da dokaže, da nima na voljo drugega pravnega sredstva, s katerim bi učinkoviteje zavaroval svoj pravni položaj. Ker se pravni interes, kot smo tudi že ugotovili, pri dajatveni in oblikovalni tožbi predpostavlja, pri ugotovitveni tožbi pa ga mora tožnik posebej izkazati, je razumljivo, da se je na tem področju oblikovala obsežna sodna praksa, tako višjih sodišč, ki odločajo v pritožbenem postopku, kot tudi Vrhovnega sodišča RS.

Title:LEGAL INTEREST ''CONDICTIO SINE QUA NON'' AS A DECLARATORY ACTION
Abstract:A lawsuit is the plaintiff's request for legal protection and it opens a process called litigation. To be admissible, procedural requirements have to be met. In civil proceedings, a procedural requirement means a circumstance or an attribute that must or must not be present for the trial to be admissible. Legal claims are classified as claims for performance (condemnatory claims), declaratory claims and constitutive action, depending on the content of the protection requested by the plaintiff and the content of the legal claims. The existence of procedural requirements for condemnatory and constitutive claims are assumed and do not have to be demonstrated, while this is not the case for declaratory action. The existence of procedural requirements is necessary for a declaratory action. In the absence of any of them the court does not decide on the merits of the claim. Interests for bringing proceedings are different and depend on the plaintiffs, but legal interest is a prerequisite for a declaratory action. Legal interest is one of the fundamental principles of civil litigation. As a procedural requirement for the admissibility of declaratory action it requires from the plaintiff to prove that its legal position is threatened due to uncertainty of the legal relationship and that declaratory action is the most appropriate remedy to eliminate this uncertainty. It also requires the plaintiff to prove that no other legal remedy for effective protection of his or her legal status is available. As already established, legal interest is assumed for the condemnatory and constitutive claims. Since the plaintiff has to demonstrate it in a declaratory action, it is understandable that the case law is extensive for higher courts, deciding in the appeal process, and the Supreme Court.
