Abstract:Osrednja tema diplomske naloge je ureditev standardizacijskega sistema v Evropski uniji ter vpliv, ki ga ima standardizacija proizvodov na delovanje notranjega trga. Standardi so tehnične specifikacije za večkratno ali trajno uporabo, ki jih je odobril priznan standardizacijski organ, katerih uporaba je prostovoljna. Standardizacija služi poenotenju tehničnih zahtev, poenostavitvi zakonodaje in odstranjevanju tehničnih ovir trgovini na mednarodni ravni. Evropska standardizacija se odvija v okviru neodvisnih standardizacijskih teles ter igra osrednjo vlogo pri zagotavljanju pravilnega delovanja notranjega trga. Za preprečevanje tehničnih ovir trgovini znotraj unije se uporabljajo načelo vzajemnega priznavanja, harmonizirana zakonodaja unije ali Uredba o evropski standardizaciji v povezavi z Direktivo EU o postopku obveščanja na področju tehničnih standardov in tehničnih predpisov. Slednja določa obveznost držav članic, da druga drugo in Evropsko komisijo obveščajo o nacionalnih tehničnih predpisih, ki jih pripravljajo. Namen obveščanja je, da bi se izognili ustvarjanju novih ovir v trgovini. Pravna posledica opustitve notifikacije je neveljavnost nenotificiranih predpisov. Evropska komisija lahko z izdajo uradne zahteve po standardizaciji od evropskih organizacij za standardizacijo zahteva razvoj evropskih standardov. V okviru »novega pristopa« usklajena zakonodaja EU vsebuje le bistvene varnostne zahteve, ki jih morajo izpolnjevati proizvodi, ki se prodajajo na trgu. Oblikovanje tehničnih specifikacij je prepuščeno priznanim standardizacijskim organizacijam. Standardi, pripravljeni po naročilu Evropske komisije so harmonizirani standardi. Od objave dalje njihova uporaba ustvarja domnevo o skladnosti z ustrezno direktivo. Skladnost z vsemi bistvenimi zahtevami veljavne zakonodaje EU označuje namestitev oznake CE na proizvodu.

Title:STANDARDISATION AND THE INTERNAL MARKET OF THE EU
Abstract:The main subject of the thesis is the regulation of the standardisation system of the European Union and the effect of standardisation of products on the functioning of the internal market. Standards are technical specifications approved by a recognised standardisation body, intended for common or repeated use, with which compliance is not mandatory. Standardisation is used to unify technical regulations, simplify legislation and to remove barriers to trade at an international level. European standardisation is carried out by independent standardisation bodies and it plays a central role in the proper functioning of the internal market. Means of preventing technical barriers to trade in the EU are the use of the mutual recognition principle, legislative harmonisation and the use of Regulation on European standardisation and the Directive laying down a procedure for the provision of information in the field of techical standards and regulation. The Directive sets up a mechanism that requires Member States to inform other Member States and the European Commission about their technical regulations at a draft stage. The goal of the notification procedure is to prevent new technical barriers to trade being created. Failure to notify technical regulations renders such regulations inapplicable. The European Commission can issue standardisation requests (mandates) to the European standardisation bodies. Under the "new approach" legislative harmonisation is limited to essential safety requirements with which products put on the market must conform. The task of drawing up technical specifications is entrusted to competent standardisation bodies. Standards elaborated under mandates of the European Commission are known as harmonised standards. Compliance with them results in a presumption of conformity with Directives' essential requirements. The CE marking indicates a product's compliance with EU legislation.
