Abstract:Diplomsko delo obravnava poglavitne razlike med gradbeno in podjemno pogodbo.

Title:MAIN DIFFERENCES BETWEEN CONSTRUCTION AND SERVICE CONTRACT
Abstract:Construction contract is a form of service contract. Because it`s complicated and the extent of work is much wider than at a service contract, it calls for a special regulation. It is regulated in it`s own chapter of our Obligation codification. In cases which are not regulated in this chapter it comes to the use of service conrtact regulations. The matter of construction contract is also regulated in several other regulations such as Special construction customs, Building act, ect. Because there is a legal correlation between both contracts, there is often a dillema which of the legal rules should be used. It is frequently the case, that during the legal process in court a lower instance decides to subject the contract to rules of one and the higher court decides for rules of the other contract. Although the rules are the same for some parts, they tend to be completely different in others. That is the main reason that it is of extreme importance which of the rules the court decides to use. The consequences of this decision can influence both parties, the client and the contractor. There are differences in duration of accountability, changes of the agreed price, the influence of ignoring the prescribed contract form on its validity and other.
