Title:ZAVRNITEV REGISTRACIJE ZNAMKE IZ RAZLOGA PODOBNOSTI

Abstract:Znamke so ena izmed pravic industrijske lastnine, katere osnovna funkcija je razlikovanje med istovrstnim ali podobnim blagom oziroma storitvami različnih tržnih subjektov. Kot znamka se sme registrirati znak ali kombinacija znakov, ki omogočajo razlikovanje blaga ali storitev enega podjetja od blaga ali storitev drugega podjetja in jih je mogoče grafično prikazati. V diplomski nalogi bo pisano o podobnosti znamk po pravilu podobnosti, kot izhaja iz enega izmed relativnih razlogov za zavrnitev (lahko tudi kršitev) registracije znamk (točka b) prvega odstavka 44. člena Zakona o industrijski lastnini). V prvem delu diplomske naloge bo pojasnjen potek registracije znamke, pravna sredstva imetnikov znamk ter splošen opis relativnih razlogov za zavrnitev registracije. V drugem – obširnejšem delu naloge pa gre za podrobnejši opis in razčlenitev pravila podobnosti na posamezne institute. Presoja obstoja verjetnosti zmede, ki vključuje tudi verjetnost povezovanja s prejšnjo znamko, je odvisna od splošne ocene več soodvisnih dejavnikov. Ti vključujejo: podobnost znakov, podobnost blaga in storitev, razlikovalne in dominantne elemente nasprotujočih si znakov, razlikovalni učinek prejšnje znamke in upoštevno javnost. Prvi korak pri ocenjevanju ali obstaja verjetnost zmede je vzpostavitev teh petih dejavnikov, drugi korak pa je ugotovitev njihovega pomena. Omenjeni instituti bodo v nalogi pojasnjeni z vsebinsko analizo ob sprotnem navajanju sodne prakse slovenskega Upravnega sodišča, Splošnega sodišča, Sodišča EU in UUNT.

Title:REFUSAL OF THE REGISTRATION OF THE TRADEMARK ON THE GROUND OF SIMILARITY
Abstract:Trademarks are one of the industrial property rights, whose primary function is, to distinguish between identical or similar goods or services to various market entities. A brand may be registered as a mark or a combination of marks, which allows to distinguish goods or services of one company from the goods or services of another company, and can be represented graphically. The thesis discusses the similarity of brands by the rule of similarity, as follows from the one of the relative grounds for refusal (or violation) of registration of brands (point b) first paragraph of Article 44. of the Law on Industrial Property). The first part of the thesis explains the course of brand registration, legal remedies for brand holders and the general description of the relative grounds for refusal of registration. The second – wider part of the thesis is about a more detailed description and about the breakdown of the rule of similarity to individual institutes. Assessment of the likelihood of confusion, which also includes the likelihood of association with the earlier mark, is dependent on the general evaluation of several co-dependent factors. These include: similarity of marks, similarity of goods and services, distinctive and dominant elements of contradictory marks, distinctiveness of the earlier mark and the relevant public. The first step in assessing whether there is a likelihood of confusion is the establishment of these five factors, the second step is finding their meaning. The mentioned institutes will be explained in the thesis with a substantive analysis and with the continuous indication of jurisprudence of the Slovenian Administrative Court, General Court, EU Court od Justice and the OHIM office. The thesis will not consider trademark reputation and other grounds for refusal due to excessive volume of the topic. Methodes that were used when making the thesis are the descriptive and comparative method with the studying of domestic and foreign professional literature. We will also be interested if the Slovenian jurisprudence follows the foreign jurisprudence.
