Title:ALTERNATIVNO PRESTAJANJE KAZNI MLADOLETNIŠKEGA ZAPORA

Abstract:Diplomska naloga obravnava kazenskopravno sankcioniranje mladoletnih storilcev kaznivih dejanj s fokusom na načinu izvrševanja kazni mladoletniškega zapora. Preučena je meja kompatibilnosti sistema kazenskih sankcij, predvidenih primarno za polnoletnike in kazenskih sankcij zoper mladoletnike, ob upoštevanju bistvenih razlik med mladoletniki in polnoletniki kot izhodišča za ločeno kazensko obravnavo obeh kategorij. Podrobneje je obravnavana možnost alternativnega načina izvrševanja mladoletniškega zapora na način, ki je predviden za kazen zapora. Za kvalitativen sklep o upravičeni dopustitvi takega načina prestajanja mladoletniškega zapora nudi diplomska naloga preučitev različnih vidikov obravnavanja mladoletnikov skozi zgodovinski razvoj. Posamezna poglavja služijo kot vsebinske iztočnice za ugotovitev skladnosti obeh omenjenih načinov in s presojo zakonskih določb mladoletniškega zapora ter korekcij kratkotrajnih zapornih kazni, nudijo širši kontekst k razumevanju najprimernejše rešitve. Preučitev je podkrepljena z vključitvijo sodne prakse in statistične analize. Iz predstavljene zahteve po smatranju mladoletniškega zapora kot ultima ratio, so kazenskopravne ureditve v spekter mladoletniškega kazenskega prava vključile vzgojno naravnanost. Prav ta pa je bistvenega pomena za smatranje mladoletniškega kazenskega prava kot ločenega sistema s posebnimi značilnostmi.

Title:SERVING ALTERNATIVE SENTENCE IN JUVENILE PRISON
Abstract:The thesis focuses on criminal sanctions of juvenile offenders with an emphasis on the methods of implementation of juvenile prison sentences. The compatibility of criminal sanctions intended primarily for adults, as well as criminal sanctions intended for juvenile offenders, are studied considering the main differences between minors and adults as a starting point for a separated criminal deals of both categories. The alternative methods of juvenile prison executions which provide for a sentence of imprisonment are studied in detail. The thesis offers a study of different aspects of discussed juveniles throughout the history for a qualitative judgment, whether such execution of juvenile prisons is eligible for admission. Individual chapters serve as content cues for determining the compliance of both mentioned executions. Furthermore, they offer a wide context for understanding the most appropriate solutions by estimating statutory provisions of juvenile prisons and the corrections of short-term imprisonments. The analysis is supported by case-law and statistical analysis. The criminal-law regulation included educational orientation into the spectre of juvenile criminal law of presented requests to consider juvenile prisons as ultima ratio. This educational orientation has the vital importance for considering juvenile criminal law as a separate system with its unique characteristics.
