Title:Odnos obveščevalno-varnostnih sistemov do kazenskih postopkov - primerjalna analiza ureditev Slovenije in Srbije : magistrsko delo

Abstract:Problematika posebnih preiskovalnih ukrepov v izvedbi obveščevalno-varnostnih služb je z mednarodnega vidika in vidika primerjanih držav neločljiv del kazenskopravne in varnostne politike. Dejavnost obveščevalno-varnostnih služb se mora izvajati usklajeno s podobnimi dejavnostmi na tem področju. Javna pooblastila v rokah varnostnih organov posameznih držav lahko povzročajo dualizem pri izvajanju preiskovalnih dejanj. Te okoliščine tako vplivajo na zmedo pri preiskovanju, preprečevanju in odkrivanju določenih kaznivih dejanj. V zvezi s tem smo določili standardizacijo pravnih predpisov in nadzor procesnih dejanj obveščevalno varnostnih služb kot inherenten del pravosodne problematike, ki nedvomno vplivata na oceno zakonitosti takega ravnanja. S primerjalno analizo pravnih sistemov Slovenije in Srbije smo raziskovali notranjo varnostno politiko ter procesno logiko v postopkih obveščevalno-varnostnih preiskav. Države imajo diskrecijsko pravico izvajanja notranje varnostne politike, ki določa dejavnosti in pooblastila nacionalnih obveščevalno-varnostnih služb. Razlike med pravnimi sistemi primerjanih držav lahko povzročijo zakonsko neujemanje predpisov s področja obveščevalno-varnostnih preiskav. V luči naporov reševanja mednarodne kazenske problematike smo določili varstvo človekovih pravic in osnovnih svoboščin kot temelj za presojo dovoljenosti obveščevalno-varnostnih dokazov. Če so izpolnjeni vsi pravni pogoji, ni nobenega dvoma o ustavnosti tako zbranih dokazov.

Abstract:The issue of special investigative measures used by the intelligence and security services is from an international perspective and the viewpoint of the compared countries an inseparable part of the criminal law and security policy. The activities of the intelligence and security services must be carried out in line with similar activities in this particular field. Public powers in the hands of security bodies in individual countries may cause dualism in the execution of investigative acts. Consequently, these circumstances generate confusion in the investigation, prevention and detection of criminal offences that need to be proven beyond doubt before a court of law. The standardisation of legal regulations and supervision of procedural acts were thus determined to be an inherent part of the judicial issue of the treatment of evidence provided by the intelligence and security services, and they undoubtedly influence the assessment of the legality of such action. A comparative analysis of the legal systems of Slovenia and Serbia was made in order to explore the internal security policy and the procedural logic of the investigation procedures carried out by the intelligence and security services. The state has the discretion to implement criminal legislation, which determines the activities and powers of the national intelligence and security services. The differences between the legal systems of compared countries may cause statutory discrepancies in regulations related to the field of investigations carried out by the intelligence and security services. In the light of the efforts to solve the issue of the international criminal legislation, we identified human rights and basic freedoms as the fundamentals for the evaluation of evidence obtained in such a way. When all legal conditions are fulfilled, there is no doubt about the constitutionality of evidence gathered in such a manner.
