Title:RAZVOJ DOKTRINE ''IN HOUSE'' NAROČIL SKOZI PRIZMO ODLOČITEV SODIŠČA EVROPSKE UNIJE

Abstract:Področje javnih naročil sproža številna pravna vprašanja in razprave glede učinkovitega pravnega urejanja. Javna naročila predstavljajo velik del bruto domačega proizvoda , zato bi moral biti pristop k ureditvi tega področja bolj sistematičen in usmerjen k razvoju kakovostne javno naročniške zakonodaje. Vendar je bilo to področje zaradi potreb prilagajanja pravu Evropske unije podvrženo predvsem ad hoc spremembam zakonodaje, ki niso bile naravnane v smeri uporabne in enostavnejše zakonodaje. Kot posledica tega se vse pogosteje srečujemo z netransparentnostjo, prezapletenostjo in korupcijskimi tveganji v postopkih javnega naročanja. Kot eno izmed osrednjih vprašanj v pravu javnih naročil se je tako pojavilo razlikovanje med postopki oddaje javnih naročil, pri katerih je javni razpis obvezen, in postopki oddaje naročil, pri katerih javni razpis ni obvezen. Namen diplomskega dela je predstaviti institut notranjih izvajalcev oziroma doktrino Teckal, ki predstavlja legitimno izjemo od uporabe pravil o javnem naročanju, če so za to izpolnjeni določeni pogoji. Omenjeni institut nima podlage v direktivah s področja javnih naročil, ampak ga je priznalo Sodišče Evropske unije in ga skozi sodno prakso izkristaliziralo. V tej zvezi je najprej obravnavan zakonodajni okvir javnega naročanja, ki ga je oblikoval naš zakonodajalec, in relevantne izjeme s tega področja, pri čemer je nujno obravnavanje direktiv Evropske unije, ki urejajo zadevni sektor. Osrednjega pomena je preučitev in razvoj pogoja organizacijske ter gospodarske odvisnosti notranjega subjekta, ki opredeljujeta ta institut. Čeprav je sodišče v bogati sodni praksi postavilo jasna merila in okvire, ta izjema ni bila dosledno prenesena v nacionalno ureditev in končno tudi v »novo« direktivo, ki bo predmet implementacije v prihodnosti.

Title:DEVELOPMENT OF ''IN HOUSE'' PROCUREMENT DOCTRINE THROUGH THE PRISM OF THE JUSTICE OF THE EUROPEAN UNION
Abstract:The field of public procurement raises a number of legal issues and debates on the efficiency of the legal regulation. Public procurement accounts for a large part of the gross domestic product , therefore the approach to regulation in this area should be more systematic and directed towards the development of high-quality public subscription legislation. However this area was, due to the need to adapt the law of the European Union, subject to primarily ad-hoc changes in legislation, which were not oriented towards more useful and simpler legislation. As a result of this we are increasingly faced with lack of transparency, inherent complexity and corruption risks in the public procurement procedures. As one of the central issues in the law of public procurement is thus a distinction between the procedures for the award of public contracts, in which the public tender is mandatory, and procedures for the award of orders for which the public tender is not obligatory. The purpose of the thesis is to present the institute of in-house procurement or the doctrine of the Teckal, which represents a legitimate exemption from the application of the rules on public procurement, if certain conditions are met. The above mentioned concept has no basis in the directives from the field of public procurement, but it was recognized by the Court of Justice of the European Union and crystallized through the jurisprudence. In this regard, is first discussed the legislative framework of public procurement, which is designed by our legislature and the relevant exceptions in this field. Here, the treatment of the directives of the European Union, governing the ancillary sector, is imperative. Of central importance is the study and development of the condition of the organizational and economic dependence of the internal entity which is defined in this institute. Although the court in the rich jurisprudence set clear criteria and frameworks, this exception has not been consistently transferred into national legislation and finally also in the "new" directive, which will be the subject of implementation in the future.
