Title:DOSTOP DO INFORMACIJ JAVNEGA ZNAČAJA V SLOVENSKIH OBČINAH

Abstract:Diplomsko delo je sestavljeno iz teoretičnega dela in raziskave. V teoretičnem delu je obravnavan Zakon o dostopu do informacij javnega značaja, ki opredeljuje informacijo javnega značaja, načelo prostega dostopa do informacij, zavezance za dajanje informacij, načine dostopa do teh informacij ter pritožbeni postopek na Informacijskega pooblaščenca in sodno varstvo. Teoretični del prinaša tudi pregled sodne prakse s področja dostopa do javnih informacij, tj. stališče Ustavnega, Vrhovnega in Upravnega sodišča. Omenjeni zakon je prinesel večjo ozaveščenost državljanov glede pravic ter večji nadzor nad porabo javnega denarja. V empiričnem delu naloge sem ugotavljala, v kolikšni meri občine v Republiki Sloveniji spoštujejo Zakon o dostopu do informacij javnega značaja. Zanimalo me je zlasti, ali občine zahtevane informacije posredujejo v zakonsko določenem času. Na 212 občin sem naslovila zahtevo za dostop do informacije javnega značaja, in sicer na polovico občin eno (pomoč ob rojstvu otroka), na polovico občin pa drugo vprašanje (povrnitev materialnih stroškov in potni nalogi za župana v letu 2014). Velika večina občin je odgovorila v zakonsko določenem roku. Po ponovnem pozivu po izteku zakonsko določenega roka, deloma tudi preko Informacijskega pooblaščenca, je bilo poslanih še nekaj odgovorov, 5 občin pa sploh ni odgovorilo. Poleg tega je bilo pri vprašanju v zvezi z določenimi izplačili županu tudi s strani občin postavljenih več vprašanj o namenu iskanja informacij, in tudi vsebina odgovorov na drugo vprašanje ni bila vedno zadovoljiva.

Title:ACCES TO PUBLIC INFORMATION IN SLOVENIAN MUNICIPALITIES
Abstract:The thesis consists of a theoretical part and research. In the theoretical part I deal with the Law on Access to Public Information Act, which defines public information, the principle of free access to information for persons providing information, ways to access this information and the procedure on appeal by the Information Commissioner and the judicial protection. The theoretical part provides an overview of case law on access to public information, ie. position of the Constitutional, Supreme and Administrative court. The Act has brought a greater awareness of citizens regarding rights and greater control over the use of public money. In the empirical part of the thesis I determined the extent to which the municipalities in Slovenia are respecting the Law on Access to Public Information. I wondered in particular whether the municipalities are transmitting requested information within the prescribed time. In 212 municipalities, I sent a request for access to public information, on one half of the municipalities one question (childbirth allowance) and on the second half of the municipalities the second issue (reimbursement of material costs and travel orders for mayor in 2014). The vast majority of the municipalities responded within the legal deadline. Following a fresh appeal after the expiry of the statutory period, partly through the Information Commissioner, it was sent a few replies, 5 municipalities did not respond. In addition, the issue related to the defined benefit mayor also by municipalities set more questions about the purpose of searching for information, and the content of the answers to the second question has not always been satisfactory.
