Abstract:	Danes se države v razvoju srečujejo z ogromnimi investicijskimi potrebami in oblikovalci politike s počasno rastjo prihodkov iz davkov in z visokimi davčnimi obremenitvami ter predvsem z omejenim financiranjem, postajajo pozorni na novo obliko financiranja investicij. Glavna ovira pri uveljavljanju avtonomnosti nacionalnih politik so postale proračunske omejitve, zato je v tem kontekstu koncept javno zasebnega partnerstva postal pomemben v večini evropskih držav. Javno-zasebno partnerstvo je v prvi vrsti eden od možnih načinov sodelovanja javnega in zasebnega sektorja, ki zagotavlja vire financiranja, obnovo ali izgradnjo, upravljanje in vzdrževanje predmeta infrastrukture, povezane z zagotavljanjem storitev splošnega gospodarskega pomena tako imenovanih javnih storitev. V okviru javno-zasebnega partnerstva se izvajanje in zagotavljanje javnih storitev, ki jih tradicionalno zagotavlja javni sektor s transparentnimi postopki prenesejo na zasebni sektor. Javno-zasebno partnerstvo je torej način zbiranja sredstev iz zasebnih virov, kar omogoči hitrejše zapolnjevanje infrastrukturnih vrzeli in na ta način izboljšanje izkoristka pri zagotavljanju infrastrukture. Skupni imenovalec sklenitve javno-zasebnega partnerstva je dober strukturni projekt, ki je predpogoj za uspeh pri katerem mora javni partner biti sposoben natančno specificirati rezultate storitev ter prepustiti inovativnost in optimizacijo za njihovo doseganje zasebnemu partnerju. Poleg tega je ena izmed temeljnih prednosti sklenitve javno-zasebnega partnerstva dolgoročnost pogodb, prenos dolgoročnih tveganj na zasebni sektor in možnost projektnega financiranja. Cilji financiranja in izvajanja javnih storitev na način javno-zasebnega partnerstva so predvsem povečanje, spodbujanje in reguliranje zasebnih vlaganj v javno infrastrukturo in druge projekte v javnem interesu. Na ta način razbremenimo javne finance, pravočasno zagotovimo infrastrukturo in sicer brez nepredvidenih podražitev ter v tem sklopu prebivalstvu zagotovimo večjo blaginjo. Izboljša se kvaliteta in obseg storitev, ki so v javnem interesu poleg tega pa se zagotovi večja pravna varnost tako javnemu kot zasebnemu sektorju.

Title:	FINANCING AND PERFORMING OF PUBLIC SERVICES USING THE CONCEPT OF A PUBLIC-PRIVATE PARTNERSHIP
Abstract:	Developing countries today are facing huge investment challenges. In the face of the slow growth of national tax revenues and high tax burdens, in particular in relation to limited financing, the policy designers have become increasingly aware of the new form of investment financing. Budgetary constraints have become the main obstacle when it comes to enforcing the autonomy of national policies. Therefore the idea of a public-private partnership in this context has been gaining more and more importance in the most European countries. The public-private partnership is in the first line one of a possible ways for a co-operation between the public and private sector which provides financing sources, the reconstruction or construction, the management and upkeeping of the subject of infrastructure connected with the provision of services of a general economic importance of the so called public services. The performance and provision of public services – which are traditionally provided by public sector – are in the frame of a public-private partnership transferred in a transparent way onto private sector. The public and private partnership accordingly indicates a way of raising funds from private sources which allows us faster fill the infrastructure gaps, guaranteeing a better yield when providing the infrastructure. The common denominator for the conclusion of a public-private partnership is a good structural project which is a precondition for success, however, where the public partner has to be able to accurately specify the results of services and leave the innovation and optimisation for their fulfillment to the private partner. The basic advantages of a public-private partnership are a long validity of contracts, a transfer of long-term risks into private sector and the possibility for project financing. The main objectives of financing and performance of public services in a public-private partnership are in particular the increase, encouragement and regulation of private investments into public infrastructure and other projects of public interest. In this way, public finances are relieved and the infrastructure suffers no unforeseen cost increase, herewith improving the welfare of population. This leads to a better quality and scope of services which are in public interest, providing also a better legal safety for both the public as well as the private sector.
