Title:IZROČILNA POGODBA NEKOČ IN DANES

Abstract:V diplomski nalogi smo izpostavili način prehoda premoženja za življenja, pogodbo o izročitvi in razdelitvi premoženja za življenja, ki ji skrajšano rečemo kar izročilna pogodba. Gre za stari pravni institut, s katerim so po navadi na kmetih izročali kmetije mlajšim generacijam oziroma določenemu potomcu, ki je kot lastnik in gospodar nadaljeval z delom na kmetiji. Bistvo je v izročitvi premoženja, ki pa večkrat vsebuje določene zgovore – preužitek, s katerim si izročevalec zagotovi dostojen preostanek življenja. Prejemnik, ki je prejel vredno premoženje, je dolžan za prejeto tudi nekaj storiti, dati, zagotoviti, se nekako oddolžiti za to, kar mu je nekdo (izročevalec) dal. Če se prejemnik dogovorjenega ne drži, lahko pride do razveze izročilne pogodbe, za kar pa morajo obstajati tehtni razlogi. Seveda izročilne pogodbe poznamo še danes. Zaradi najdenih primerkov izročilnih pogodb v domačem arhivu, se nam je zdelo zanimivo, da jih predstavimo v diplomski nalogi ter s tem prispevamo k ohranitvi tradicije, takratnega jezika, načina življenja. Tako smo vključili izročilno pogodbo iz leta 1888, za katero še ni bil značilen izraz izročilna pogodba, temveč prepodajna pogodba. Glede izročitve iste kmetije sledi izročilna pogodba iz leta 1941 in nato še izročilna pogodba iz leta 2005. V diplomski nalogi smo predstavili njihovo vsebino in jih na podlagi zakonske ureditve na posameznih delih primerjali.

Title:DEED OF CONVEYANCE IN THE PAST AND TODAY
Abstract:This thesis focused on the manner of property transfer, the property conveyance and distribution contract or deed of conveyance in short. It is an old legal construct that was commonly used in rural areas to transfer a farm to a representative of a younger generation who continued working there as its owner and master. The main aspect of the contract is property conveyance that usually contains certain legally agreed rights to means of subsistence (usufruct) which secures the conveyor to spend the remainder of his or her life in a decent manner. The transferee of the property is obliged to meet certain commitments; to give something in return for the property he or she received from the conveyor. If the transferee does not fulfil his or her obligations, the deed of conveyance may be revoked under reasonable conditions. Deeds of conveyance are, of course, still in use today. Since we discovered deed of conveyance examples in our family archive, we deemed it necessary to present them in a thesis to contribute our share in upholding the tradition, archaic language and the way of life. To this end, the thesis includes a deed of conveyance from 1888 which features interesting archaic terminology. The farm that is the subject of the latter contract is also transferred in the one from 1941 and 2005 that was presented as well. The thesis describes their contents and compares their legal systems.
