Title:Pojav deviantnega vedenja pri osebah z motnjami avtističnega spektra : diplomsko delo univerzitetnega študija

Abstract:O pojavu avtizma se v zadnjih dvajsetih letih govori veliko več, kot se je govorilo nekoč. Gre za pervazivne razvojne motnje, ki človeka prizadenejo že v zgodnjem otroštvu in se pojavljajo skozi njegovo celotno življenje. Ljudje, ki jih prizadenejo spektroavtistične motnje, imajo težave v komunikaciji, socialnih interakcijah, živijo v določeni rutini ter kažejo pretirane interese za določeno stvar. Veliko je bilo ugibanj, kaj sploh je razlog za pojav avtizma in kje so vzroki zanj. Nekateri znanstveniki so slednje iskali v genetiki, okolju, prehrani in tudi cepivih, vendar vse do danes natančni vzroki še niso znani. Zaradi vseh značilnosti, ki jih imajo ljudje z motnjami avtističnega spektra, se pogosto zgodi, da se takšni posamezniki znajdejo v kazenskem postopku, bodisi kot žrtve, priče ali osumljenci. Pogosto se posamezniki z avtizmom ne zavedajo, da je njihovo vedenje v družbi nesprejemljivo in je lahko celo kaznivo. V primeru kaznivega dejanja se morajo v primer vključiti organi kazenskega pregona. Zanje je bistvenega pomena prepoznava in primeren odziv, saj je z avtisti zaradi njihovih značilnosti potrebno ravnati drugače. Tudi v primeru zaslišanja se je avtistični osebi potrebno prilagajati in se držati določenih nasvetov, kako zaslišanje voditi. V samem kazenskem postopku, v katerega so vpletene osebe z motnjami avtističnega spektra, lahko pride do kršenja Miranda pravic. To se lahko zgodi zaradi posameznikovega nerazumevanja teh pravic. Za boljšo osveščenost organov kazenskega pregona o avtizmu je potrebno dodatno izobraževanje in usposabljanje, ki ga v nekaterih državah širom sveta že izvajajo.

Title:THE PHENOMENON OF OFFENDING BEHAVIOUR IN PERSONS WITH AUTISM SPECTRUM DISORDERS
Abstract:For the last twenty years, a lot more has been said about the occurence of autism, than it has in the past. Autism is a pervasive developmental disorder which affects humans in early childhood and occur throughout their entire life. People affected by autism spectrum disorder have difficulties in communication, social interactions, and live by a certain routine showing excessive interest in particular matters. There are numerous speculations behind the reason causing the occurrence of autism. Scientists have experimented and researched in the field of genetics, environment, nutrition and vaccines, however the exact causes remain unknown. Because of all the characteristics that people with autism spectrum disorders have, it often happens that such individuals find themselves in the criminal proceedings, either as victims, witnesses or suspects. People with autism are often unaware that their bahviour is unacceptable and might even be considered criminal. In the case of criminal offense, law enforcement agencies have to step in. Recognition and appropriate response is essential for them, as people with autism require careful treatment and understanding of their characteristics. It is important that the process of interrogating is adjusted and managed accordingly. In criminal proceedings in which people with autism spectrum disorder are involved, the violation of Miranda rights often occurs based on a limited understanding of the individual's rights. Better awareness of law enforcement authorities on autism requires additional education and training, which in some countries around the world have already implemented.
