Title:Pravni vidiki in sodna praksa mobinga na delovnem mestu : diplomsko delo visokošolskega strokovnega študija, program Organizacija in management kadrovskih in izobraževalnih sistemov

Abstract:V času globalizacije in razvoja tržne miselnosti delo in presežek dela postaja vedno večja vrednota in zahteva delodajalcev. Uspešen in zavzet zaposleni je bolj učinkovit, s tem pa prinaša večji dobiček. Odvisnost od tržnih zakonitosti zahteva zaposlovanje kadra, ki bo upravičil vedno večja pričakovanja. Da bi zagotavljali dostojanstvo na delovnem mestu in preprečevali kakršnekoli oblike trpinčenja na delovnem mestu je pomembna tudi slovenska zakonodaja in spreminjanje le-te v smeri pravne ureditve in izboljšanja sistema pri samem reševanju sporov, ki nastanejo pri trpinčenju na delovnem mestu (mobingu). Trpinčenje (v nadaljevanju mobing) na delovnem mestu predstavlja grožnjo podjetju kot celoti in zaposlenim, ki s svojim delom soustvarjajo poslovno uspešnost. Problematika mobinga se širi in dobiva nove razsežnosti, zaradi spremenjene zakonodaje, ki temelji na prepovedi vsakršnega trpinčenja na delovnem mestu, morajo podjetja vedno več časa posvetiti tudi oblikovanju in sprejetju ustrezne politike preprečevanja trpinčenja na delovnem mestu, izraziti morajo predvsem stališča in načela združbe do trpinčenja ter se opredeliti do sankcij le-teh, ko se pojavi. Organizacije in posamezniki se le redko zavedajo problematike mobinga, njegove razširjenosti in ustreznih ukrepov, s katerimi je mogoče mobing preprečevati, zato je pomembno prepoznavanje in razumevanje tega pojava ter zavedanje o njem, da bomo lahko učinkovito pristopili k preprečevanju psihičnega nasilja na delovnem mestu.

Title:LEGAL ASPECTS AND THE JURISPRUDENCE OF MOBING IN THE WORKPLACE
Abstract:In the era of globalization and the prevalence of market mentality, work and surplus work are becoming an increasingly treasured value as well as a requirement demanded by employers. A successful and committed employee is more efficient, and consequently produces a greater profit. A dependence on market forces demands the recruitment of such cadres that will justify increasingly large expectations. The Slovenian legislation plays an important role in ensuring workplace dignity and preventing any form of maltreatment in the workplace. Also important are changes to the Slovenian legislation in the direction of legislative regulation and an improvement of the system for conflict resolution concerning conflicts arising from maltreatment in the workplace (mobbing). Maltreatment (in continuation referred to as mobbing) in the workplace poses a threat to the company as a whole, as well as to its employees who co-create its business success. The problem of mobbing is expanding and gaining new dimensions, and due to changes in legislation, which are based on the prohibition of any type of maltreatment in the workplace, companies are also forced to devote more and more time to the formulation and adoption of appropriate policies for the prevention of maltreatment in the workplace. They must primarily state the views and principles of the organization on maltreatment and define the sanctions that follow when such maltreatment occurs. Organizations and individuals are seldom aware of the problem of mobbing, its prevalence and of appropriate actions that can be used to prevent it. Therefore it is important to recognize and understand this phenomenon, and also to be aware of it so that effective approaches to the prevention of psychological violence in the workplace can be undertaken.
