Title:DELOVNO-PRAVNI POLOŽAJ VISOKOŠOLSKEGA UČITELJA

Abstract:V skladu z veljavnim Zakonom o visokem šolstvu (v nadaljevanju: ZVIS) so visokošolski učitelji, docent, izredni profesor, redni profesor ter lektor. V visokošolskih strokovnih programih so visokošolski učitelji tudi predavatelji in višji predavatelji. Delo visokošolskega učitelja zajema raziskovalno delo na svojem področju. Svoje prispevke k razvoju znanosti visokošolski učitelji objavljajo v mednarodnih in domačih znanstvenih in strokovnih revijah, knjigah in elektronskih medijih. Delo visokošolskega učitelja sega tudi na opravljanje pedagoškega dela (posredna in neposredna pedagoška dejavnost). V sled navedenega lahko visokošolskega učitelja opredelimo tudi kot nekoga, ki skozi različne oblike pedagoškega dela (predavanja, seminarji, vaje,…) prenaša svoje znanje na študente visokošolskih zavodov. Delovnopravni položaj visokošolskega učitelja je v Republiki Sloveniji urejen z različnimi zakonskimi in podzakonskimi predpisi. Pri opredelitvi delovnopravnega položaja visokošolskega učitelja je bistvenega pomena predstavitev pogojev, ki so potrebni za zasedbo delovnega mesta. Temeljni pogoj za zasedbo delovnega mesta visokošolskega učitelja v Republiki Sloveniji je izvolitev v naziv, t.i. habilitacijski postopek, skozi katerega se odraža tudi ustavna pravica univerze t.j. avtonomija univerze. V primeru neizpolnjevanja navedenega pogoja ni mogoča sklenitev pogodbe o zaposlitvi z visokošolskim učiteljem oz. sodelavcem oz. nastane razlog na strani delodajalca za redno odpoved pogodbe o zaposlitvi iz razloga nesposobnosti.

Title:EMPLOYMENT POSITION OF UNIVERSITY TEACHER
Abstract:Pursuant to the applicable Higher Education Act (HEA), the position of the higher-education teacher encompasses the assistant professor, associate professor, full professor and foreign-language assistant. In higher-education technical programmes the position also encompasses the lecturer and senior lecturer. The position consists of research work in the corresponding academic discipline of the teacher. Their contributions to the development of science are published in international and local scientific and technical magazines, books and electronic media. The position of the higher-education teacher also covers educational work (direct and indirect pedagogical activity). Therefore, a higher-education teacher can be defined as someone who passes his or her knowledge onto university students or higher-education students through various kinds of teaching methods (e.g. lectures, seminars, tutorials etc.). In the Republic of Slovenia the working position of the higher-education teacher is regulated by various laws and regulations. In defining this position it is essential to present the conditions that are needed to apply for the post. The essential condition in order to apply for the position of the higher-education teacher in the Republic of Slovenia is the election to an academic rank or what is also known as “habilitation procedure” or “promotion procedure”, through which the constitutional right of the university, and therefore its autonomy, is also reflected. In the event of failure to comply with the condition it is not possible to conclude the contract of employment with a higher-education teacher or colleague. The contract is therefore terminated by the employer due to incompetence.
