Title:RAZMEJITEV MED ZAPOREDNIM PREVOZOM, PODPREVOZOM IN MULTIMODALNIM PREVOZOM

Abstract:Diplomsko delo govori o razmejitvi treh oblik prevoznih pogodb pri katerih je udeleženih več prevoznikov; to so: zaporedni prevoz, podprevoz in multimodalni prevoz. Vsebina pravnih pravil, ki zadevajo zaporedni prevoz, podprevoz in multimodalni prevoz ni enotna v štirih vejah prevoza znotraj nacionalne in mednarodne ureditve. Obligacijski zakonik kot splošni predpis določa vsebino zaporednega prevoza in podprevoza. Zaporedni prevoz je tisti prevoz pri katerem je zaporedoma udeleženih več prevoznikov. Zaporedni prevozniki odgovarjajo za škodo, izgubo ali zamudo solidarno. Podprevoz nastane kadar prevoznik poveri izvedbo dela ali celote prevoza podizvajaicu oziroma podprevozniku. Podprevoznik, ki pri prevzemu tovora prevzame tudi tovorni list, postane zaporedni prevoznik in solidarno odgovarja pošiljatelju. Vsebina teh institutov pa je raznolika znotraj panožnih zakonov. Multimodalni prevoz ni urejen v splošnem predpisu, njegova vsebina pa je enako urejena v predpisih o ladijskem, cestnem in letalskem prevozu, le železniški prevoz ga ne pozna. Multimodalni prevoz nastane, kadar se za prevoz tovora zavežejo prevozniki vsaj dveh različnih prevoznih panog. Podjemnik multimodalnega prevoza odgovarja po enotnih pravilih za celotno prevozno pot. Mednarodni multimodalni prevoz je neurejen, zato je avtonomija strank tista, ki ob pomoči avtonomnih pravil mednarodnih organizacij, določa vsebino pravic in obveznosti iz pogodbe o multimodalnem prevozu.

Title:THE DISTINCTION BETWEEN SUCCESSIVE CARRIAGE, SUBSEQUENT CARRIAGE AND MULTIMODAL CARRIAGE
Abstract:The subject of this thesis is the distinction between three forms of transport contracts which involve two or more carriers; they are: successive carriage, subsequent carriage and multimodal carriage. Content of provisions which concerne successive carriage, subsequent carriage and multimodal carriage is not unified within four branches of transport in national and in international law. Code of obligations, as the general rule, provides content for succesive carriage and subsequent carriage. Successive carriage is the one which successively involves several carriers. Successive carrierers are liable for damage, loss and delay on the principle of joint and several liability. Subsequent carriage is formed when a carrier entrusts a subsequent carrier the execution of transport, either a part or the whole transport route. If a subsequent carrier takes the waybill at the same time when he takes over cargo, he by the law becomes a successive carrier and therefore is jointly and severally liable to the shipper. Four branches of transport regulate this matter differently. Multimodal transport is not regulated by the Code of obligations. Its content is regulated with provisions of marine, road and air ransport rules. Only rail transport regulations have no provisions regarding multimodal transport. Multimodal transport is formed when carriers of two or more transport branches stipulate they will transport a shipment. Multimodal transport operator is liable for damage, loss or delay on the principle of uniform liability for the whole route. International multimodal transport is poorly regulated. With help of autonomus rules of international organisationsis, the party autonomy is the one, which defines rights and duties of contract parties.
