Title:Razvoj standarda zasebnosti v slovenskem kazenskem postopku : diplomsko delo univerzitetnega študija

Abstract:Pravica do zasebnosti je po svoji naravi kompleksna, večdimenzionalna ter spreminjajoča, saj so nekateri aspekti omenjene pravice tesno povezani z tehnološkim razvojem. Nove tehnologije po eni strani omogočajo nove tehnologije nadzora, hkrati pa tudi razvoj novih metod dela kriminalnih skupin. Temeljni akt, s katerim je pravica do zasebnosti zajamčena v Republiki Sloveniji, Ustava (1991), tako jamči varovanje vseh aspektov pravice do zasebnosti, tudi če ti v omenjenem aktu niso izrecno poimensko določeni. Kljub temu, da je pravica do zasebnosti posameznikova ustavna pravica, ki v najsplošnejši obliki izhaja iz 35. člena Ustave (1991), pa jo je v določenih primerih dopustno omejiti ter posegati vanjo. Tovrstni posegi v omenjeno pravico so v demokratični družbi dopustni le tedaj, ko se s tem varuje širši javni interes. Zaradi omenjene kompleksne in večdimenzionalne pravice do zasebnosti mora biti kazensko procesna zakonodaja posamezne države urejena tako, da organom pregona omogoča učinkovito preiskovanje kaznivih dejanj, hkrati pa mora ohranjati načelo sorazmernosti in zagotavljati ustrezen standard varovanja pravice do zasebnosti. Slovenska kazensko procesna zakonodaja je bila v obdobju od osamosvojitve deležna številnih sprememb. V sklopu naše prve hipoteze smo ugotovili, da so te spremembe potekale v smeri izboljšav in odpravljanja nepravilnosti. V sklopu druge hipoteze smo ugotovili, da je slovenska zakonodaja ustrezna za pregon sodobnih oblik kriminalitete, vendar je pri tem potrebno upoštevati, da sodobne kriminalne grožnje presegajo nacionalni nivo. V sklopu zadnje hipoteze smo ugotovili, da slovenska ureditev predvideva visok standard varovanja zasebnosti, v primerjavi s tujino, kljub nekaterim pomanjkljivostim.

Title:THE DEVELOPMENT OF THE STANDARD OF PRIVACY IN THE SLOVENIAN CRIMINAL TRIAL PROCEDURE
Abstract:The right of privacy is complex, multidimensional and also constantly changing by its nature, because some aspects of the right of privacy are strongly bonded with technological progress. On one hand, the new technologies mean new ways of surveillance, but on the other hand, these new technologies can be used by criminals too. The Constitution (1991) presents the Slovenian fundamental act, that guarantees protection of all aspects of the right of privacy, even if they are not expressly mentioned in the Constitution (1991). Although the right of privacy is a constitutional right, which is in general guaranteed by Article 35 of the Constitution (1991), it can be, in some cases restricted and interrupted. The right of privacy can be, in a democratic society interrupted only in cases, when is that essential for the protection of the general public interest. As we already mentioned before, the right of privacy is complex and multidimensional by its nature. Because of that, the criminal procedure law of the state must, on one hand, empower the agents of law enforcement in that way, that they can effective investigate all crimes, but on the other hand, the criminal procedure act must guarantee the principle of proportionality and the standard of privacy. The Slovenian criminal procedure legislation has been changed many times since the act of independence. Within our first hypothesis we have found, that those changes were made in the light of improvements and correcting mistakes. Within our second hypothesis we have found, that Slovenian legislation is suitable for the prosecution of the modern forms of criminal activities, but we must take into account, that those activities are above the national level. Within our last hypothesis we have found, that the Slovenian standard of privacy is high, in the comparison with the foreign countries, although there is still some space for the improvements.
