Title:Vedenjska biometrika, Europol in slovenska policija : diplomsko delo univerzitetnega študija

Abstract:Pri procesu identifikacije in verifikacije identitet ljudi ima danes pomembno vlogo biometrija. Večina njenih postopkov se naslanja na fiziološke in fizikalne značilnosti posameznikov, manj poznana in redkeje uporabljana pa je vedenjska biometrija. Cilj naloge je preučiti področje vedenjske biometrije, ugotoviti značilnosti vedenjskih identifikatorjev in preveriti, v kolikšni meri se organi kazenskega pregona poslužujejo teh metod. Glavna prednost vedenjske biometrije je, da lahko kot podlago za identifikacijo uporabimo vsako vedenje posameznika in da lahko na neinvaziven način naenkrat nabiramo večje število identifikatorjev, kar olajša oblikovanje multimodalnih sistemov. Pri primerjavi s klasičnimi identifikatorji smo ugotovili, da sta za uspešnost identifikacije nujni izdelava in uporaba multimodalnih profilov, saj so vedenjski identifikatorji manj zanesljivi (manj univerzalni, se hitreje spreminjajo in lahko jih tudi zavestno kontroliramo). Ob pomoči predstavnikov sodišč, strokovnjakov s področja kazenskega pregona in sodnih odločb smo ugotovili, da se vedenjska biometrija pri nas uporablja v majhni meri (izjemo predstavljata prepoznavi govorca in pisave). Podobno velja tudi za Europol, ki se na tem področju zanaša na delovanje lokalnih organov kazenskega pregona. Pri analizi pravne ureditve in sodne prakse postane jasno, da vedenjski identifikatorji niso enako zaščiteni kot klasični, kar delno izhaja iz dejstva, da je posameznikovo vedenje vsem vidno in se ga zato zlahka zajame oziroma posname. Naše mnenje je, da bi se morala pravila za hrambo in uporabo vedenjske biometrije približati pravilom, ki veljajo za klasične identifikatorje, saj omogočajo enak poseg v pravice in zasebnost posameznikov.

Title:Behavioural biometrics, Europol and the Slovene Police
Abstract:Today, biometry plays an important part in the process of identification and verification of human identities. Most of these processes use either physiological or physical human characteristics, while behavioural identifiers, both in terms of usage and public awareness. are pushed to the sidelines. Due to that fact, the goal of this work is to study the field and discern the characteristics of these types of identificators, as well as determine the extent to which law enforcement agencies make use of this technology. The main advantages of behavioural biometrics are the facts that any human behaviour can be used as the basis for identification and that different identifiers can be noninvasively collected at the same time, which facilitates the creation of multimodal biometric systems. When comparing them with other types of identifiers we discover that the formation and deployment of multimodal systems and profiles are crucial for the effectiveness of behaviour-based identification, since these types of identifiers are on average less reliable (they aren't as universal, can change faster and ca neven be consciously controlled). With the help of court decisions, court representatives and experts in the field of law enforments we ascertained that in Slovenia, with the exception of speaker and handwriting identification, bahaviorual biometrics are poorely applied. The same goes for Europol, as they rely on the work of local law enforcement agencies when it comes to this particular field. When analysing the regulation and court decision it bcomes clear, that behavioural identificatiors don't share the same protection as classical ones, which is in part due to the fact, that human behaviour is more public and that it can be captured with relative ease. In our opinion, the regulation for the storage and use of behavioural identifiers should be changed to offer the same protection as to the classical ones, since they have the same potential for privacy and rights violations.
