Title:NADOMESTNO MATERINSTVO - VPLIV ZADEVE C-167/12 NA SLOVENSKO PRAVNO UREDITEV

Abstract:V sodobnem času se pari za pridobitev otroka vse bolj poslužujejo nadomestnega materinstva. Nadomestno materinstvo zajema vse primere, ko se ženska zaveže, da bo za plačilo ali neodplačno nosila in rodila otroka in ga po rojstvu za vedno izročila sopogodbeniku- to sta navadno zakonca, lahko pa tudi par, ki živi v zunajzakonski skupnosti. Čeprav Ustava Republike Slovenije določa, da je odločanje o rojstvu otrok svobodno, pa je v Sloveniji nadomestno materinstvo prepovedano. Kazenski zakonik z zaporno kaznijo sankcionira tistega, ki protipravno opravi postopek oploditve z biomedicinsko pomočjo zaradi nadomestnega materinstva. Kaj naj torej stori slovenski par, ki želi dobiti otroka s pomočjo nadomestnega materinstva? Za razliko od Slovenije, je v Veliki Britaniji nadomestno materinstvo pod določenimi pogoji dovoljeno. Nadomestni materi pripadajo v zvezi s tem pravice, ki izhajajo iz delovnega razmerja. Vendar pa v Veliki Britaniji ni posebne ureditve glede porodniškega dopusta za žensko, ki po rojstvu otroka prevzame starševsko skrb zanj (nameravana mati). Sodišče EU je obravnavalo več primerov, ki se nanašajo na upravičenje nameravane in nadomestne matere do določenih pravic. To pa je dokaz, da, čeprav je nadomestno materinstvo v Veliki Britaniji dovoljeno, da je to področje še dokaj pomanjkljivo urejeno. V primeru C -167/12 sta C.D. in njen partner, ki živita v Veliki Britaniji, otroka dobila s pomočjo nadomestne matere. Za otroka je C.D. začela skrbeti in ga dojiti takoj po njegovem rojstvu. Nekaj mesecev po rojstvu otroka je britansko sodišče s soglasjem nadomestne matere in v skladu z britansko zakonodajo na C.D. in njenega partnerja preneslo polno in trajno starševsko skrb za otroka. C.D. je pri svojem delodajalcu vložila prošnjo za plačan dopust na podlagi njegove ureditve za posvojitev. Delodajalec je C.D. obvestil, da dogovor o nadomestnem materinstvu, ki ga je sklenila, ne izpolnjuje pogojev, ki so določeni s to ureditvijo. Vprašanje sodišča v tem primeru je, ali je treba C.D. priznati pravico do porodniškega dopusta in ali bi lahko to pomenilo diskriminacijo na podlagi spola.

Title:SURROGATE MOTHERHOOD - THE IMPACT OF CASE C-167/12 TO THE SLOVENIA
Abstract:In modern times couples are incresingly turning to surrugacy as a mean whit which they can optain a child. Surrogate motherhood contains all cases where women commite them selfes to giving birth to a baby, in return for money or for free, and are going to give the baby away to the contractor permenantly, after the baby is born. Contractors are usually married couples or couples that live in a cohabition. Even though the Constitution of Republic of Slovenia states, that the decision of having a child is a free choice, surrogate motherhood is still prohibited. Criminal law penalizes those who illegally carry out the procedure of fertilization with biomedical means with intent of assisting reproduction for surrogacy. What should a Slovenian couple, who wants to get a child through surrogacy, do ? Contrary to Slovenia, in the UK surrogacy is permitted under certain conditions. Employment relationship gives rights to the surrogate mother. However there is no special regulations in the UK, about the maternity leave for a woman who, after the birth of a child, takes parental concern for the child (the intended mother). The Court of Justice of the EU has dealth with several cases relating to the justification of the intended and surrogate mothers to certain rights. This proofs, that although surrogacy is legal in the UK it is still a poorly organized area. In the case of C-167/12, C.D. and her partner, who live in the UK, get the child with the help of a surrogate mother. C.D. began to take care and breast-feed the child immediately after his birth. A few months after the birth, the British court passed a full and permanent care for the child to C.D. and her partner, with the consent of the surrogate mother and in accordance with the UK leglislation. C.D. filed an application to her employer. The Employer notified C.D. that the agreement on surrogacy, which she entered into, does not meet the conditions that are determined with the regulations. The question of the Court in this case is, whether C.D. has a right to a maternity leave and whether it could reasult in discrimination on the basis of sex.
