Title:ZNAMKA UGLEDA IN NOTORNA ZNAMKA - PODOBNOSTI IN RAZLIKE

Abstract:Diplomsko delo obravnava blagovne znamke kot eno izmed pomembnih pravic industrijske lastnine s podrobnejšo analizo znamke ugleda in notorne znamke, ki ju pod skupnim imenom opredeljujemo kot znani znamki. Teorija je na področju prava znamk precej pestra; obstaja veliko pravnih aktov, ki pa si med seboj niso usklajeni, kar vodi do različnih interpretacij. V diplomskem delu so ti akti predstavljen v luči znanih znamk. Ugotavljamo, da sta si znani znamki kljub svoji očitni podobnosti precej različni. Najpomembnejša razlika je v pragu poznavanja obeh znamk. Za notorno znamko naj bi se namreč po interpretaciji generalnega pravobranilca, v zadevi Sodišča EU, zahteval višji prag poznavanja kot za znamko ugleda. Znamki sta si različni tudi glede varstva. Prvič, v smislu zahteve po registraciji prejšnje znamke, ter drugič, v smislu, katerim znamkam se glede na lastnosti blaga in storitev nudi razširjeno varstvo. Razlika pa obstoji tudi v pridobitvi statusa znane znamke. Skozi študij različnih določb, ki zadevajo blagovne znamke, je le malo tistih, ki jasno in določno opredeljujejo materijo, ki je predmet diplomskega dela. Prav zaradi slednjega je v diplomskem delu obilo analiz in presumpcij, v prihodnosti pa je glede na aktualnost pričakovati več pravil, predvsem v sodni praksi.

Title:TRADEMARK WITH REPUTATION AND WELL KNOWN TRADEMARK - SIMILARITIES AND DIFFERENCES
Abstract:The thesis deals with trademarks as one of the most important industrial property rights. We will look more into two of them - trademark with reputation and well-known trademark. Both trademarks are known under a common name - known trademarks. The theory is quite diverse on the topic. There are plenty of legal documents in the field, but sadly not many of them are harmonized with each other, so there are different interpretations of exact cases. In the thesis those documents are presented in the light of known trademarks. Even though known trademarks are quite similar to each other, there is still significant difference between them. The most important difference is the degree of recognition of both trademarks. According to the general attorney's interpretation in a judicial review of CJEU it was demanded that the degree of recognition of well-known trademark should be higher than that of trademark with reputation. The trademarks are also different concerning protection. Firstly, the difference can be seen in a requirement of registration of an earlier trademark and secondly, extended protection is differently interpreted with the two trademarks considering the characteristics of products and services. Another difference between the trademarks is how the two trademarks gained their statuses of especially known trademarks. Via studies of various clauses that consider trademarks, there are too many too uncertain clauses. In the light of that, thesis has a great number of presumptions and analyses. Therefore, we expect big development in this field.
