Title:Vloga detektiva pri reševanju družinsko-pravne problematike

Abstract:Detektiv je oseba, ki opravlja detektivsko dejavnost v skladu z zakonom, ki ureja to dejavnost, ter drugimi predpisi, ki zadevajo področja njegovega delovanja. Na podlagi pisnega pooblastila stranke zanjo zbira informacije, ki jih le-ta potrebuje bodisi za lastne potrebe bodisi za potrebe različnih pravnih postopkov ter opravlja različne svetovalne naloge. Detektivi so lahko strankam med drugim v več kot dobrodošlo pomoč tudi pri reševanju družinsko-pravne problematike (splošni problemi, spori in druge zadeva družinskega prava ter kazniva ravnanja znotraj družine in med partnerjema), ki je dandanes vse bolj v porastu. Z nalogo sem želela predstaviti vlogo detektiva pri reševanju tovrstne problematike. Poleg teoretične predstavitve obravnavane teme sem opravila tudi raziskavo, s pomočjo katere sem poskušala raziskati možnosti za sodelovanje detektiva s centri za socialno delo ter razširjenost detektivske dejavnosti pri reševanju družinsko-pravne problematike v Sloveniji. Ugotovila sem, da bi bilo detektivsko dejavnost dobro razširiti tudi na tista področja reševanja družinsko-pravne problematike, na katerih še ni razširjena ter razmisliti o (formalni) vključitvi detektivov v javno sfero (sodelovanje s policijo, centri za socialno delo itd.). Seveda pa mora biti sodelovanje obojestransko, saj bo le-tako izkoriščen ves potencial detektivov tako pri reševanju družinsko-pravne problematike kot tudi na ostalih področjih reševanja najrazličnejših problemov sodobne družbe.

Title:The role of a detective in solving family law problems
Abstract:A Detective is someone who performs the detective activity in accordance with the act of law governing the mentioned activity and other regulations concerning the fields of a detective’s operation. Based on a customer's written authorisation, a Detective gathers information needed by the customer, for his/her own needs or the needs of various legal proceedings, and performs various advisory assignments. Detectives' assistance can be more than helpful for the customers whose cases revolve around the solving of family-legal issues (general problems, disputes and other matters of family law and criminal conducts within a family and between partners), which are nowadays, more and more on the increase. With this Diploma Thesis, I wanted to present the role of a Detective in solving of such issues. In addition to the theoretical presentation of the issue under discussion, a research, by which I tried to explore the possibilities of a Detective's co-operation with the centres for social work and the extension of detective activity in solving of family-legal issues in Slovenia, was performed. I discovered that it would be good to extend the detective activity also to those fields of solving of family-legal issues, to which it has not been extended up to now, and to consider a (formal) inclusion of Detectives into the public sphere (co-operation with the police, centres for social work, etc.). Of course, the co-operation must be of a mutual nature, both in solving of family-legal issues as well as in other fields of solving of various problems of the modern society.
