Title:Mednarodna pristojnost, internet in potrošniki

Abstract:Diplomsko delo obravnava usmerjanje komercialne dejavnosti s pomočjo interneta, ki omogoča, da lahko potrošnik hitro in enostavno sklene pogodbo s tujim trgovcem. Ker se potrošnik v mednarodnem zasebnem pravu, nasproti tujemu trgovcu, smatra kot šibkejša stranka, je deležen posebnega procesnega varstva. V ta namen so analizirane določbe o posebni pristojnosti pri potrošniških pogodbah po prenovljeni Uredbi 1215/2012 o pristojnosti ter priznanju in izvršitvi sodnih odločb v civilnih in gospodarskih zadevah, ki med drugim uvaja novost, da lahko potrošnik toži trgovca, ki nima stalnega prebivališča v državi članici Evropske unije. Ker je definicija potrošniškega spora, sploh v povezavi z usmerjanjem komercialne dejavnosti prek interneta, povzročala številne nejasnosti, je v delu predstavljena in analizirana tudi sodna praksa Sodišča Evropske unije (SEU), ki je pristojno za enotno razlago evropske zakonodaje.

Title:International jurisdiction, Internet and consumers
Abstract:This degree dissertation discuesses pursuance of commercial or professional activities with the help of Internet, which allows a consumer to quickly and easily enter into a contract with a foreign trader. In scope of Private international law, consumers, as opposed to a foreign traders, are seen as a weaker party and entitled to special procedural protection. To this end, there are analyzed provisions on special jurisdiction for consumer contracts under the recast Regulation No. 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters. Among other things, it introduces a novelty that the consumer can sue the trader, who is not domiciled in the member states of the European Union. The definition of consumer dispute, especially involved with pursuance of commercial or professional activities with the Internet, can cause some confusion. This degree dissertation presented and analyzed the case law of the European Court of Justice (ICJ), which is responsible for the interpretation of European legislation.
