Title:SISTEM PRAVNIH PRAVIL PRI H.L.A. HARTU

Abstract:V diplomski nalogi je predstavljen H. L. A. Hartov sistem pravnih pravil, ki je zgrajen na angleškem pravnem sistemu. Hart sicer pravi, da je njegov sistem univerzalen, torej da ga je moč aplicirati na katerikoli pravni sistem. Poleg predstavitve njegovega sistema pravil se tako, da bi to njegovo tezo preverila, ukvarjam tudi z vprašanjem možne aplikacije H. L. A. Hartovega sistema na slovenski pravni red. Sistem pravnih pravil vidi Hart v sintezi primarnih in sekundarnih pravnih pravil, pri katerih se sekundarna pravna pravila nadalje delijo na pravilo o pripoznavi, pravila o razsojanju in pravila o spremembi, pri čemer je najpomembnejše pravilo o pripoznavi. Pravilo o pripoznavi je tisto, na podlagi katerega se določa, ali bo določeno pravno pravilo postalo veljavno pravno pravilo določenega pravnega sistema. Smotrnost vpeljave sekundarnih pravnih pravil pokaže Hart na primeru primitivnih skupnostih, kjer pa obstaja deficit sekundarnih pravnih pravil. Tam obstajajo le primarna pravna pravila. Z vpeljavo sekundarnih pravnih pravil se razrešijo deformacije sistema primitivnih skupnosti. V nalogi me zanima, ali spada slovenski pravni red med »moderne« pravne sisteme po Hartu, torej ne več med primitivne, zanima pa me še, če imamo v našem pravnem redu pravila o razsojanju. Pomembno vprašanje je prav tako, ali lahko predpostavljamo obstoj pravila o pripoznavi tudi v slovenskem pravnem redu. V nalogi se dotaknem tudi zapolnjevanja odprte strukture zakonov, tako s strani državljanov, kot s strani sodišč in razlage Hartovega znamenitega stavka »Zakon (in ustava) je to, kar sodišča pravijo, da je.«

Title:H.L.A. HART'S SYSTEM OF LEGAL RULES
Abstract:In my diploma thesis, I introduce H. L. A. Hart’s system of legal rules which is built in the British legal system. Hart states that his system is universal, therefore, it can be applied to any legal system. Besides introducing his system of legal rules, in order to check his thesis, I also engage with the question of possible application of the Hart's system to Slovenian legal system. Hart sees a system of legal rules in synthesis of primary and secondary legal rules amongst which secondary legal rules further divide to the rules of recognition, rules of adjudication and rules of change, where the most important rule, is rule of recognition. Rule of recognition is the one that decides if certain legal rule becomes valid legal rule of certain legal system. Hart indicates the purpose of introducing secondary legal rules with an example of primitive communities where deficiency of secondary legal rules exists and where only primary legal rules are applied. Deformities of the primitive community system are solved with the introduction of secondary legal rules. I am interested if Slovenian legal system, according to Hart, belongs to ‘modern’ legal systems, thus not primitive. Moreover, I am also interested if in our legal system we have rules of adjudication. Beside it is an important question whether we can assume the existence of rule of recognition also in the Slovenian legal system. In my thesis, I also acknowledge the open texture fulfilment of legal rules, both by the citizens as well as the court and the interpretation of Hart's famous statement: »The law (and the constitution) is what the courts say it is.«
