Abstract:Odvetništvo je kot del pravosodja samostojna in neodvisna služba, ki jo ureja zakon (137. člen Ustave RS). Odvetnik je pravni strokovnjak, ki je pri svojem delu samostojen in neodvisen in dejavnost opravlja kot svoboden poklic ter je za svoje delo tudi odgovoren stranki. Odvetništvo je častivreden poklic, katerega nastanek sega v daljno zgodovino. Poklic odvetnika zasledimo že v antiki, o organiziranem odvetništvu pa začnemo govoriti leta 1868, ko je bil na območju današnje Slovenije sprejet Odvetniški red. Sicer je pred tem odvetništvo že urejal Provizorični odvetniški red iz leta 1849. Odvetništvo se je vse do danes neprestano razvijalo, ugled odvetnikov pa je rasel in kot takšnega poklic odvetnika poznamo še danes. V dobrih 140 letih, odkar poznamo organizirano odvetništvo, je na območju današnje Slovenije veljalo deset odvetniških zakonov. Odvetniški red je kot prvi urejal odvetništvo na območju naše države in je hkrati bil najodličnejši zakon, kar jih je kadarkoli veljalo pri nas. Danes v Republiki Sloveniji odvetništvo ureja Zakon o odvetništvu (ZOdv), iz leta 1993, spremenjen leta 2001, 2008, 2009 in 2014. S področja odvetništva pa poznamo še druge predpise. Pravne podlage s področja odvetništva najdemo v določilu 137. člena Ustave RS, Kodeksu odvetniške poklicne etike (1994), v novo sprejeti Odvetniški tarifi (2003) ter številnih avtonomnih aktih Odvetniške zbornice Slovenije. Ker je Odvetniški red iz leta 1868 ključen za odvetništvo, menim da bo primerjava s sodobno ureditvijo po Zakonu o odvetništvu (ZOdv), pripomogla k boljšemu razumevanju temeljev, ki so nastali že v daljni preteklosti in brez katerih si poklica odvetnika, kot ga poznamo danes, ne bi mogli niti predstavljati.

Title:HISTORY OF THE LEGAL PROFESSION
Abstract:Attorneyship, as part of justice administration, is an independent service governed by law (as referred to in Article 137 of the Constitution of the Republic of Slovenia). An attorney is an autonomous, independent legal expert, performing his or her liberal profession with liability to his or her client. Attorneyship is an honourable profession, the origin of which reaches far back into history. Legal profession can be traced back to the earliest records in antiquity. However, organized attorneyship is not mentioned before 1868, the year when the Order of Attorneys Act was first passed in the territory of today’s Slovenia. Prior to that year, law was governed by the preceding Temporary Order of Attorneys established in 1849. Since the beginning, attorneyship has been developing constantly and has acquired the status of a highly respected profession. In 140 years and since the emergence of organised attorneyship, ten Attorney Acts have been applied in the territory of today’s Slovenia. The first to govern attorneyship was the Order of Attorneys Act, one of the finest acts that have ever been applied here. Nowadays, the attorneyship in Slovenia is governed by the Attorney Act applied in 1993, amended in 2001, 2008, 2009, and 2014. In addition to the Attorney Act, attorneyship is based on other rules and regulations, such as the legal framework of attorneyship as stated in the provision of Article 137 of the Constitution of the Republic of Slovenia, Attorneys’ Code of Ethics (1994), the newly applied Attorney Tariff (2003), and numerous other autonomous regulations of the Bar Association of Slovenia. As the Order of Attorneys Act from 1868 is of vital importance for attorneyship in general, I believe that comparing it to the contemporary arrangement based on the Attorney Act could help better understand its foundations, which have emerged already in the past and without which it would be hard to imagine the profession of an attorney as we know it today.
