Title:PRAVNA PODLAGA ZA ZAPOSLITEV IN DRUGE OBLIKE PLAČANEGA DELA V SLOVENIJI

Abstract:Delovnopravna zakonodaja se redno spreminja, zato jo je potrebno spremljati. Obravnavana tema vključuje trenutno veljavne predpise na področju delovnih razmerij in del na podlagi pogodb civilnega prava. V tem delu obravnavamo aktivnosti, ki potekajo pred sklenitvijo pogodb za plačano delo, potek sklepanja pogodb, pogodbe za plačano delo, ki so trenutno na voljo v Sloveniji ter prenehanje teh pogodb. Opredeljujemo stranke pogodb, vsebino in obliko pogodb, obveznosti in pravice pogodbenih strank. Za sklenitev pogodb o zaposlitvi je potrebno izvesti predpisane aktivnosti, ki so določene z Zakonom o delovnih razmerjih-1. Ob izbiri primernega kandidata za opravljanje plačanega dela sledi izbira primerne pogodbe dela in sklep pogodbe, ki se navadno začne s pogajanji strank pogodbe, sledi sestava ponudbe pogodbe, ki ima določen rok veljavnosti in na koncu sklep pogodbe o delu, če se obe stranki strinjata. Pogodbe o zaposlitvi se praviloma sklepajo za nedoločen čas s polnim delovnim časom, vendar Zakon o delovnim razmerjih-1 navaja še izjeme: pogodba o zaposlitvi za določen čas, pogodba o zaposlitvi s krajšim delovnikom, pogodba o zaposlitvi za opravljanje dela na domu, pogodba o zaposlitvi zaradi opravljanja javnih del, pogodba o zaposlitvi med delavcem in delodajalcem, ki opravlja dejavnost zagotavljanja dela delavcev drugemu uporabniku, pogodba o zaposlitvi s poslovodnimi osebami ali prokuristi in z vodilnimi delavci. Na ravni dejavnosti se sklepajo kolektivne pogodbe o zaposlitvi. Pogodbe za delo na podlagi civilnega prava, temeljijo predvsem na določbah Obligacijskega zakonika. Omogočajo delo na podlagi podjemne pogodbe, avtorske pogodbe, pogodb o začasnem in občasnem delu upokojencev ter študentov in dijakov, osebnega dopolnilnega dela, samozaposlovanja, kmetijskega gospodarjenja in mrežnega marketinga. Nepoznavanje in nespoštovanje zakonov in predpisov dela lahko vodi do dela na črno, ki je prepovedano. Nedoločenost zakonskih predpisov pogodb dela na podlagi civilnega prava vodi v prekarnost dela.

Title:THE LEGAL BASIS FOR EMPLOYMENT AND OTHER FORMS OF PAID WORK IN SLOVENIA
Abstract:Labour legislation is regularly changing, therefore it must be monitored. The topic of master's thesis includes the current regulations in the field of labour relations and work on the basis of civil law contracts. We introduce the activities that take place prior to the conclusion of contracts for paid work, the course of concluding contracts for paid work, which are currently available in Slovenia and the termination of these contracts. We define contract customers, the content and form of the contracts, obligations and rights of the parties. To conclude employment contracts it is necessary to implement statutory activities, which are determined by the Zakon o delovnih razmerjih-1. When selecting a suitable candidate to carry out a paid work, we select the applicable work contract and begin with the conclusion of the contract, which usually starts with the negotiations of the parties of the contract, followed by the composition of the proposed contract, which has a fixed term of validity. In the end, if both parties agree on the content of the contract, the contract is valid. The employment contracts are normally concluded for an indefinite period with a full-time working time, but the Zakon o delovnih razmerjih-1 lists the exceptions: a contract of employment for a fixed term, contract of employment with shorter working hours, the employment contract for working at home, employment contract for public works, employment contract between the worker and the employer who performs the activity of providing workers to another user and the employment contract with managerial staff or procurators and managers. Collective labour agreements are concluded based on field of activities. Contracts for work on the basis of civil law are based primarily on the provisions of the Obligacijski zakonik. It enables parties to conclude contract for royalties, contract on temporary and occasional work for pensioners and students, personal supplements work, self-employment, farm management and multi-level marketing. Ignorance and disregard for labour laws and regulations can lead to undeclared work, which is prohibited. The vagueness of legal regulations on labour contracts under civil law leads to a work precarity.
