Abstract:Uspešna podjetja se zavedajo, da je izbira ustrezne domene ključnega pomena za njihovo dobičkonosno poslovanje. Ponavadi izberejo domeno, ki sovpada z njihovo registrirano znamko. V kolikor ugotovijo, da je le-ta že zasedena, so jo pripravljena pridobiti tudi z zlorabo postopka reševanja domenskih sporov. Diplomsko delo obravnava omenjeni problem, t. i. obratno ugrabitev domene, ki je opredeljena kot pritožnikova (imetnik znamke) uporaba pravil v slabi veri, z namenom odvzeti domeno registriranemu imetniku domene. Diplomsko delo se osredotoča na mednarodni izvensodni postopek reševanja sporov »UDRP« . Predstavljene so prednosti in slabosti pravil tega postopka, s poudarkom na slednjih. Delo navaja številne odločbe razsodišč in na podlagi le-teh izpostavlja okoliščine, ki nakazujejo na obratno ugrabitev domene. Skozi delo avtorica kritično ugotavlja, da pravila postavljajo stranki v neenak položaj. Imetnik domene, ki je ponavadi šibkejša stranka v postopku, za razliko od pritožnika nima nobenega vpliva na izbiro ponudnika reševanja sporov, poleg tega obratnega ugrabitelja ne doleti nobena sankcija ob ugotovitvi zlorabe postopka, notranji pritožbeni postopek pa sploh ne obstaja. Delo navaja rešitve, ki bi pripomogle k izboljšavam na tem področju. Avtorica predlaga reformo pravil v smeri pravičnejšega obravnavanja obeh strank v postopku.

Title:Reverse domain name hijacking
Abstract:Successful companies are aware that choosing the proper domain name is of crucial importance for their profitable business. They usually choose a domain name that matches their registered trade mark. If they find that it is already occupied, they are willing to get it with the abuse of the domain name dispute resolution procedure. The thesis deals with this problem, so-called reverse domain name hijacking, which means using the Policy in bad faith to attempt to deprive a registered domain-name holder of a domain name. The thesis focuses on "UDRP", international extrajudicial dispute resolution procedure. The advantages and disadvantages of this procedure are presented, with an emphasis on the latter. The thesis lists a number of panel decisions and on the basis of these, it highlights conditions that indicate a reverse domain name hijacking. Through the thesis the author critically notes that the rules place the parties in an unequal position. The holder of the domain name, which is usually the weaker party of the proceeding, unlike the complainant has no influence on the selection of the dispute resolution provider, in addition, reverse domain name hijacker does not get any sanction if he is accused of abuse of the process, and the internal appeal procedure does not exist. The thesis outlines the solutions that could contribute to improvements in this area. The author suggests the reform of the rules towards more equitable treatment of both parties.
