Abstract:V svojem diplomskem delu, ki nosi naslov: Sodna poravnava – ali je lahko pogojna, sem se ukvarjala z analizo sodne odločbe Vrhovnega sodišča, z opravilno številko VSM I Cp 975/2010, z dne 20.06.2013, prav tako sem se opredelila do vprašanja ali je dopustno skleniti pogojno sodno poravnavo, torej ali je mogoče skleniti sodno poravnavo pod odložnim ali razveznim pogojem. Diplomsko delo je razdeljeno na splošni in posebni del. Sodno poravnavo uvrščamo v sklop alternetivnega reševanja sporov. Sodna poravnava (res judicialiter transacta) je dogovor strank, s katerim slednje uredijo svoje civilnopravne odnose, s katerimi lahko prosto razpolagajo in privede do zaključka pravdnega postopka oziroma prepreči, da do začetka postopka sploh pride. Sodno poravnavo lahko sklenejo le pravdne stranke, k njej pa lahko pristopijo tudi tretje osebe. Pri proučevanju teme, ki jo obravnava diplomska naloga sem izhajala iz splošnih ugotovitev in stališč o sodni poravnavi v naši pravni ureditvi. Naš Zakon o pravdnem postopku izrecno ne govori o možnosti sklepanja pogojnih sodnih poravnav, a je slednjim nakolnjena naša sodna praksa. Pri pisanju diplomskega dela sem prišla do zaključka, da je možno skleniti pogojno sodno poravnavo, ampak samo pod odložnim pogojem, ne pa tudi pod razveznim pogojem, in sicer zaradi učinkov le-tega. Prav tako sem se v diplomskem delu opredelila do vprašanja nastopa pravnomočnosti pogojne sodne poravnave ter vprašanja, kdaj se šteje, da je slednja veljavno sklejena.

Title:COURT SETTLEMENT - MAY IT BE CONDITIONAL
Abstract:In my thesis, entitled: Court settlement– can it be conditional, I was dealing with the analysis of the judgment of the Supreme Court, with reference number VSM I Cp 975/2010, dated 20/6/2013, in which I defined the question whether it is permissible to enter in to a conditional settlement of the case, therefore is it possible to conclude a judicial settlement under the suspensive or resolutory condition. The thesis is divided in a general part and a special part. Court settlement is part of alternative dispute resolution. Court settlement (res judicialiter transacta) is an agreement with which the parties organize their civil relations, with which they can freely dispose of and leads to the conclusion of civil litigation or prevent the initiation of the procedure taking place at all. Court settlement may be concluded only party in the litigation and that it may also benefit third parties. In considering the topics addressed by the thesis, I derive from the general findings and observations of court settlement in our legal system. Our Civil Procedure Act does not explicitly talk about options for the contingent of court settlement, but our jurisprudence is favorable to them. While writing the thesis, I came to the conclusion that it is possible to conclude conditionally court settlement, but only under the condition precedent, but not under resolutory condition, due to the effects thereof. While writing my thesis I was also dealing with the question, when does a conditional settelment get a legal effect and when is valid.
