Title:Sodelovanje policije s pravosodnimi organi : diplomsko delo visokošolskega strokovnega študija Varnost in policijsko delo

Abstract:Danes smo priča vedno zahtevnejšim oblikam kaznivih dejanj. V primeru neučinkovitega kaznovanja storilcev v sodnem postopku se išče krivca v glavnih subjektih, ki so policija, državno tožilstvo in sodišče. Zato smo v tem delu raziskali področje sodelovanja navedenih subjektov in ugotovili, da je sodelovanje policije z državnim tožilstvom in sodiščem najbolj intenzivno v predkazenskem postopku. Cilj je bil ugotoviti, na kakšen način in kako poteka sodelovanje teh organov ter kakšen je njihov odnos. Gospodar predkazenskega postopka je državni tožilec, ki lahko pri svojem delu usmerja delo policije, ta pa je navodila dolžna upoštevati. Naloga policije pa je preiskovanje in odkrivanje kaznivih dejanj, za kar je posebej usposobljena. Za izvajanje preiskovalnih dejanj je zadolženo sodišče, prav tako pa izdaja odredbe za izvrševanje določenih ukrepov. Te odredbe izvršuje policija, prav tako pa mora sodišče obveščati o izvedenih preiskovalnih dejanjih. Policija je v funkcionalnem pogledu podrejena tako državnemu tožilstvu, kot sodišču. Sodelovanje med navedenimi organi je zakonsko dobro urejeno. Predvsem pri sodelovanju policije in sodišča posebnosti nismo zaznali, zaznali pa smo pomanjkljivosti pri sodelovanju policije z državnim tožilstvom v praksi, zato bo v prihodnje potrebno temu posvetiti več pozornosti.

Title:Police Cooperation with Judicial Authorities
Abstract:Today we are witnessing increasingly more sophisticated forms of crime. In the event of ineffective punishment of perpetrators within court proceedings, the guilty party is sought after from the main subjects such as the police, state prosecution and the courts of justice. Therefore, in this section we looked into the field of cooperation of these listed subjects and found that cooperation between the police, public prosecution and the courts is most intense in preliminary pre-trial proceedings. The objective was to determine the manner and methods in which these bodies work together and what their attitudes are. The master of pre-trial proceedings is the public prosecutor, who, under his own direction, may guide the work of the police, who are obliged to comply with his instructions. The task of the police is the investigation and detection of criminal offences, for which it is especially qualified. The court is in charge of implementing investigative measures and issues orders for the execution of certain measures as well. These orders are carried out by the police who must also notify the court regarding any investigatory actions conducted. In the functional sense, the police are subordinate to both the public prosecutor and the court. Cooperation is legally well-regulated between these bodies. In general, there were no specifics detected in cooperation between the police and the courts, while in practice shortcomings between the police and the public prosecution were detected, making it necessary to devote more attention to this matter in the future.
