Title:	Stvarnopravni status energetske infrastrukture

Abstract:	Izgradnja hidroelektrarn na spodnji Savi je trenutno največji slovenski projekt izgradnje energetske infrastrukture za pridobivanje energije iz obnovljivih virov, natančneje vode. Projekt predvideva izgradnjo petih hidroelektrarn (v nadaljevanju tudi: HE) na območju spodnje Save od Boštanja kot prve HE do Mokric kot zadnje na meji pred Republiko Hrvaško. Za navedeni projekt je Republika Slovenija podelila koncesijo za izkoriščanje energetskega potenciala spodnje Save, ki med drugim natančno določa sam potek izgradnje s terminskim planom, financiranje in obveznosti, ki izhajajo iz projekta, tako za koncedenta kot tudi koncesionarja. Po končani izgradnji posameznega energetskega objekta, je potrebno urediti njegov stvarnopravni status, skladno z določbami koncesijske pogodbe in veljavne zakonodaje. Gre za skupek pravnih in upravnih postopkov, ki natančno določajo korake urejanja stvarnopravnega statusa. Sam projekt izgradnje se je pričel v letu 2002, dokončne ureditve stvarnopravnih statusov do sedaj zgrajenih objektov pa so se v večini izvedle med leti 2010 in 2015. Ker je področje vpisov objektov HE v Sloveniji zelo različno (ne)urejeno in ker se je v času izgradnje spreminjala zakonodaja tako na področju graditve objektov kot tudi na stvarnopravnem področju, se je ponekod orala ledina in ustvarjala nova pravna praksa glede urejanja stvarnopravnih položajev. Trenutno imajo vse tri že zgrajene hidroelektrarne v verigi na spodnji Savi dokončno urejene statuse. Podeljen jim je status gospodarske javne infrastrukture, zemljišča so ustrezno evidentirana, objekti so vpisani v kataster stavb. Na podlagi podeljenih stavbnih pravic, je urejeno tudi lastniško stanje objektov HE, kar je izkazano z ustreznimi vpisi v zemljiško knjigo. Vendar žal to ni praksa na celotnem območju Republike Slovenije. Primerjava z verigo HE na reki Dravi je pokazala, da na tistem območju stvarnopravni statusi še niso primerno kategorizirani oziroma urejeni ter da bo potrebno še kar nekaj pravnih in upravnih postopkov, da se bo vzpostavilo ustrezno stanje, predvsem v obliki ureditve lastništva na stavbah v zemljiški knjigi.

Title:	Rem status of energy infrastructure
Abstract:	The construction of hydroelectric power plants on the lower course of the river Sava is the largest energy infrastructure project currently under way in Slovenia for generating electricity from renewable sources, specifically water. The project envisages the construction of five hydroelectric power plants (HPPs) on the lower course of the river Sava, from Boštanj as the first HPP to Mokrice as the last HPP before the border with the Republic of Croatia. To carry out the project, the Republic of Slovenia has granted a concession for harnessing the energy potential of the lower course of the river Sava, which, among other things, sets forth in detail the construction schedule, project financing and obligations under the project, applicable both to the granting authority and the concessionaire. After completion of construction, the status of each of the power plants needs to be formalized under property law in compliance with the provisions of the concession agreement and applicable laws. Essentially, this process comprises a series of legal and administrative procedures which detail the exact steps for formalizing the status under property law. The project started back in 2002, but statuses under property law for most of the facilities completed to date have only been formalized between 2010 and 2015. Since the area dealing with the formalization of HPP facilities varies greatly across Slovenia and because the building code and property law have undergone changes during the course of the HPP construction, the whole process at times entailed breaking fresh ground and introducing new legal practices. To date, statuses of all the three already completed hydroelectric power plants on the lower course of the river Sava have been formalized. They have been granted public utility status, with parcels of land properly documented and facilities recorded in the buildings registry. Also, the ownership status of the HPP facilities has also been formalized based on the granted building titles, as evidenced by their corresponding land registry records. This, however, is not the case across the whole of the Republic of Slovenia. A comparison with the chain of HPPs on the river Drava has shown that statuses under property law have not yet been properly categorized or formalized there and that quite a number of legal and administrative procedures will need to be completed in order to set the record straight, particularly concerning the recording of facility ownership titles in the land registry.
