Abstract:Solastnina ima svoje korenine že v rimskem pravu. Solastnina je nastala kot posledica dedovanja, kjer so dediči podedovali nerazdeljeno premoženje. Solastniki so lahko podali zahtevo po delitvi skupnega premoženja, kot lahko to storijo tudi v sodobnem pravu. Pojem solastnine je tako že rimsko pravo razvilo kot lastninsko pravico več oseb na nerazdeljeni stvari, na kateri imajo solastniki miselne deleže. Solastninsko razmerje pa je žal velikokrat predmet nesoglasij med solastniki, saj ga je v praksi težko izvajati zaradi lastništva nerazdeljene stvari oz. precej abstraktnega pojma idealnega deleža. Zato pravo daje solastnikom možnost, da lahko kadarkoli, razen ob neprimernem času, zahtevajo njeno delitev. Ta je lahko sporazumna ali pa o njej odloči sodišče v nepravdnem postopku. Sodišče najprej preveri, če je mogoča fizična delitev solastne stvari. Sicer pa udeleženci lahko v postopku ponudijo odkup deleža ostalih solastnikov ali pa pride do civilne delitve, kjer sodišče na javni dražbi solastno stvar proda in kupnino razdeli med solastnike. S pomočjo sodne prakse se odločitve sodišč močno olajšajo, saj le ta služi kot posvetovalno orodje. Sodišča ga s pridom uporabijo tudi pri odločanju o delitvi solastnine, saj primeri iz sodne prakse vežejo sodišča v podobnih primerih, s pomočjo uporabljene argumentacije. Namen diplomske naloge je predstaviti pojem solastnine in njeno delitev s pregledom aktualne sodne prakse.

Title:MANAGING JOINT OWNERSHIP WITH CURRENT CASE LAW REVIEW
Abstract:Joint ownership originates from the Roman law. It was a consequence of the inheritance by which the heirs inherited the undistributed joint assets. Joint owners could request a distribution of joint assets, just as they can do under the modern law. The concept of joint ownership has thus been defined by the Roman law as a multi-people ownership rights to undistributed joint assets, where the joint owners have ideal shares (pars pro indiviso). Unfortunately, joint ownership is quite often a subject of disagreements as it is hard to implement it in the practice due to the ownership of undistributed assets or rather abstract concept of ideal share. Therefore, the law gives joint owners a possibility to request the distribution of those assets at anytime except for the inappropriate time. This can be done by an agreement or is decided by court in non-contentious proceedings. The court should first examine the possibility of physical distribution of the joint assets. Otherwise the parties in the proceedings can offer to purchase the assets from the others or civil distribution is executed, where the court sells the joint assets by public auction and the proceeds of sale are distributed among joint owners. Case law can serve as a consulting tool and can significantly facilitate the decisions of the court. The courts use the case law fairly often also when deciding on distribution of joint assets as the courts are tied to similar cases with used argumentation. The purpose of my thesis is to explain the concept of joint ownership and its distribution on the basis of modern case law.
