Abstract:Iz zgodovine človeštva razberemo, da so selitve ljudstev nepredvidljive, a hkrati tako zelo stalne. In prav selitve prvih skupin ljudi ter kasneje narodov so sooblikovale in še oblikujejo današnjo družbo in trenutne razmere v katerih se nahaja ves svet. V kazenskem postopku beguncev je potrebno zagotavljati višje ravni varstva procesnih jamstev, saj so argumenti za drugačno obravnavanje dejanske narave. Ti zaradi svoje intenzivnosti zahtevajo pravne rešitve, s katerimi naj bi se beguncem v kazenskem postopku zagotovil procesni položaj, primerljiv s procesnim položajem drugih domnevnih storilcev v kazenskem postopku. Kakršnokoli kaznovanje beguncev, ki so v državo sprejema vstopili nezakonito, brez upoštevanja okoliščin pobega, je kršitev mednarodne obveznosti države in zahteva njeno mednarodno odgovornost ob kumulativni izpolnjenosti pogojev iz 31. člena Konvencije o statusu beguncev, postopke končati tako, da begunec zaradi njega ne bo trpel nobenih negativnih posledic. Obstoj skupne evropske azilne politike naj bi predvideval ne le nekaj pravil, ki urejajo posamična parcialna vprašanja znotraj širšega področja, temveč celoviti nabor ukrepov, ki bi zajeli vse bistvene elemente. Povsem jasno je, da za migracije takih celovitih sklopov pravil ni.

Title:PROCEDURAL GUARANTIES OF REFUGEES
Abstract:The history of mankind clearly shows that migrations of peoples are unpredictable. And exactly the migrations of peoples and later of nations have had and continue to play a decisive influence on the evolution of modern society, particularly the current global situation. In refuge related legal procedures it is necessary to ensure higher standards of processuality security, as the arguments for a different treatment are of a factual nature. Due to its intensity these require legal solutions, which ensures for the refugees in a legal procedure in a position, comparable with the procedural position of other suspected perpetrators in a legal procedure. Any punishment of refugees, who have entered the host state illegally without observing the circumstances of their escape, is a violation of the state’s international duties and calls upon its international responsibility to observe the cumulative compliance with the provisions of article 31. of the convention on the status of refugees, and to close the procedures in such a manner, that no refugee will suffer any negative consequences as a result. The existence of a common European asylum policy should not encompass only a few rules, which settle individual partial questions within the wider scope, but should rather present a holistic range of measures, covering all essential elements. It is perfectly clear, that there are no such holistic sets of rules for migrations.
