Title:Amnestija in pomilostitev v Republiki Sloveniji : diplomsko delo visokošolskega strokovnega študija Varnost in policijsko delo

Abstract:V diplomski nalogi smo opredelili pojem amnestije in pomilostitve. Prikazali smo postopek amnestije in pomilostitve in odgovorili na vprašanje komu se lahko podelita in kdo ju lahko podeljuje. Pokazali smo, kakšne so omejitve pri izdajanju aktov milosti. Analizirali smo pomilostitve in se posebej osredotočili na odmevnejše primere pomilostitev. Raziskali smo vzroke za odločitev o pomilostitvi oziroma zavrnitvi prošnje za pomilostitev. Pod drobnogled smo vzeli tudi sprejeta zakona o amnestiji in »zakon o aboliciji«. Po slovenski zakonodaji o pomilostitvah odloča predsednik države, zato smo se lotili vprašanja, kolikšne pristojnosti ima predsednik države pri pomilostitvi. Zanimalo nas je, kdo mu svetuje pri odločanju o prošnjah za pomilostitev, ali je povsem avtonomen pri odločitvah in, ali je vezan na kakšna pravna mnenja. Opredelili smo se tudi do vprašanja, ali bi bilo smiselno bolj podrobno urediti izdajo akta o pomilostitvi v kazenskem zakoniku oziroma celoten postopek pomilostitve. Primerjali smo tudi slovensko zakonodajno ureditev amnestije in pomilostitve z ureditvijo v Republiki Hrvaški ter Združenih državah Amerike. V ZDA imajo predsedniški sistem organizacije državne oblasti in s tem tudi zelo zanimivo ureditev obeh aktov milosti. V dolgi zgodovini demokracije v ZDA je bilo kar nekaj odmevnih in tudi kontroverznih odločitev o pomilostitvi, zato smo predstavili enega od odmevnejših primerov.

Title:Amnesty and pardon in the Repulic of Slovenia
Abstract:In the thesis we defined terms amnesty and pardon, we described procedure of giving amnesty and pardon and answered the question whom can it be given and who has the jurisdictions to give these acts. We showed what limitations in granting of amnesty and pardon are. We analyse all the reasons for given or dined pardon and also examine accepted laws of amnesty and “law of abolition”. By Slovenian legislation the president decides whom shall grant pardon. Therefore, we addressed the question of how much jurisdiction does the president have in giving the pardons. We were curious who advises him in deciding about requests for pardon. Is he completely autonomous in decisions regarding requests for pardon or is he bound to some legal opinions? We will also define how it would be better to adjust the pardon in the criminal code and the entire procedure of granting pardon. We also compared Slovenian amnesty and pardon legal framework with the framework of the republic of Croatia and United States of America. The latter have a presidential form of government and thus also a very interesting framework of both acts of mercy. In long history of democracy that the US have, there have been, quite a few high-profile and controversial decisions about requests for pardon. Therefore, we presented one of the famous decisions for granting a request for pardon in US history.
