Abstract:Živimo v svetu, ki je iz dneva v dan nevarnejši do nas, odraslih, predvsem pa do otrok, ki se zaradi svoje starosti in nedolžnosti tega še ne zavedajo. Otroci velikokrat postanejo žrtve spolnih prestopnikov, med katere sodijo tudi pedofili. Pomembno je, da vemo, kaj pomeni izraz pedofilija. Pri tem nastane težava, saj zanj ne obstaja enotne razlage. Definicije se med seboj razlikujejo in dopolnjujejo, a kljub temu lahko strnemo, da je to bolezen, ki nastane zaradi osebnostne motnje odrasle osebe, ki čuti privlačnost do otrok, to pa lahko kaže na različne načine, in sicer z nadlegovanjem, s tipanjem, z igranjem pornografskih igric, božanjem in podobno. K pedofiliji so podvrženi predvsem otroci, ki ustrezajo profilu pedofila. To so po navadi osamljeni, negotovi, nesamozavestni in nesamostojni otroci, ki hrepenijo po pozornosti, ljubezni, poslušanju in po zaupanju. Vsi bi radi obranili svoje otroke pred pedofili. Da bi to dejansko lahko storili, je zelo majhna verjetnost, saj so lahko že najbližji znanci (prijatelji, učitelji, trenerji idr.) prav eni izmed napadalcev. Razlage, zakaj nekdo postane pedofil, se razlikujejo, a največkrat takšna oseba postane nekdo, ki je bil v svojem otroštvu zlorabljen, in to vodi naprej. Pri vsem tem imajo težko nalogo policisti. Ta se pojavi že na samem začetku, torej pri odkrivanju kaznivega dejanja. Otroci le stežka priznajo oz. povejo, da so bili žrtve, saj tega niti ne dojemajo kot kaznivo dejanje. Ko pride do utemeljenega suma kaznivega dejanja, pa je zelo pomembno dokazovanje oz. zaslišanje pedofila. Tovrstno zaslišanje se močno razlikuje od zaslišanja drugih storilcev kaznivih dejanj (kraja, preprodaja mamil). Raziskave po svetu kažejo, da ima pri zaslišanju pedofilov velik vpliv empatija. Pomembno je, da preiskovalec pokaže empatični odnos. S tem mislimo, da pokaže razumevanje situacije, v kateri se je znašel pedofil. V večini primerov se preiskovalci pri zaslišanju pedofilov ne odzovejo tako. Ker so pri vsem tem žrtve otroci, smo za zadeve še ranljivejši, zato so pedofili v veliki meri deležni ponižanja, agresije itn. Tak odnos jih le odvrne od priznanja svojega kaznivega dejanja. Pomembno vlogo pri vsem tem pa igrajo izkušnje preiskovalca, ki lahko v odločilnem trenutku pripomorejo k priznanju.

Title:THE USE OF EMPATHY IN INVESTIGATIVE INTERVIEWS WITH PAEDOPHILES
Abstract:Nowadays, we live in a world, which is constantly becoming more dangerous for us adults, and even more so for children, who are not yet aware of this fact, due to their age and innocence. Children often become victims of sexual delinquents, a group which also includes paedophiles. It is important for us to be aware of what the term paedophilia actually means. This is where we encounter a problem, since there is no unified explanation of the term. The definitions are different and complementary, however they can be summed up as a disease, which develops due to a personality disorder of an adult, who feels attraction towards children and can show it in many different ways, for instance by harassment, touching, playing pornographic games, stroking, etc. Children, matching the profile of a paedophile, are especially subjected to it. These children are usually lonely, insecure, unconfident and dependent, they also yearn for attention, love, someone to listen to them and trust them. Everyone would like to defend their children from paedophiles. The likelihood of that happening is actually very low, since the attackers could be some of your closest acquaintances (friends, teachers, coaches, etc.). The explanations as to why a person would become a paedophile differ, however, an individual most often becomes this way due to the fact that they themselves were abused in their childhood. The job of police officers in the matter is very difficult. The very beginning, which means the finding of a criminal offence, is difficult in itself. Children have a difficult time of admitting that they were the victims of such acts, since they do not perceive them as criminal. By the point when there is reasonable doubt of committing a criminal offence, it is very important to prove the act and interrogate the paedophile. The interrogation of a paedophile is very different to the interrogation of other criminal offenders (theft, drug trafficking). Global research shows that empathy plays an important role in the interrogation of paedophiles. It is important for the interrogator to shown an emphatic attitude. This means that he should show an understanding of the given situation of the paedophile. In most cases, this is not how investigators reach while interrogating paedophiles. Due to the fact that children are the victims of such crimes, we become even more vulnerable, which is why paedophiles are often met with humiliation, aggression, etc. Such an attitude only deters them from admitting that they have committed a criminal offence. The investigator’s experience plays a crucial role in the matter, since it can help to obtain a confession in a decisive moment.
