Abstract:	V Sloveniji je večina vodovodne infrastrukture v lasti države oziroma občin, zato so skoraj vse novogradnje in vzdrževalna dela podvržena javnemu naročanju. Na trgu je veliko ponudnikov vodovodnega materiala, ki se prijavljajo na javne razpise. Mnogi med njimi se prijavijo na razpis, kljub temu da ne ustrezajo pogojem v razpisni dokumentaciji. V postopku javnega naročanja je najpomembnejša dobro pripravljena razpisna dokumentacija. Z njo ponudnik lahko pripravi ponudbo, ki ustreza pogojem in zahtevam naročnika. V obravnavanem primeru se je prijavil ponudnik, katerega material ni ustrezal tehničnim zahtevam razpisne dokumentacije. To je bilo razvidno iz prospektov proizvajalca. Kljub temu je ponudnik z raznimi dokumenti dokazoval nasprotno. S preiskavami vzorca cevi v laboratoriju se je sum o neustreznosti materiala potrdil. Da bi bila ponudba transparentna in bi popolnoma ustrezala razpisnim pogojem, naročnik potrebuje strokovnjake, ki poznajo potrebe naročnika in pripravijo ustrezno razpisno dokumentacijo ter na koncu odločajo pri izbiri ustrezne ponudbe.

Title:	SELECTION OF SUPPLIER WITH PUBLIC PREKUREMENT IN INFRASTRUCTUR SECTOR
Abstract:	In Slovenia, most of the plumbing infrastructure is owned by the government or municipalities, therefore almost all new constructions and maintenance works are subject to public procurement. There are multiple plumbing material providers on the market who apply for public tenders. Many apply, even though they do not comply with the terms of tender documentation. The most important part of the public procurement procedure is a well prepared tender documentation. With it, the tenderer can prepare such a bid that meets the tenderee's conditions and demands. In the studied example, the applied tenderer's material did not comply with the technical specifications of the tender documentation, which was clear from the manufacturer's information leaflets. Nevertheless, the tenderer tried to prove the contrary with various documents. The laboratory analysis of the pipe sample confirmed the suspicion of the material inadequacy. In order to ensure a transparent bid which perfectly meets the tender conditions, the tenderee needs experts who are familiar with the tenderee's requirements and can prepare the adequate tender documentation, as well as help choosing the suitable bid in the end.
