Title:Pravna regulativa sistemskega operaterja pri sklepanju služnosti za potrebe gradnje prenosnega omrežja

Abstract:V današnjem času, povečana raznovrstna uporabnost električne energije, zahteva v energetski infrastrukturi nove investicije. Vemo, da se električne energije ne da uskladiščiti in jo kasneje uporabljati. Večkrat slišimo, da si občani tega planeta, ne predstavljajo življenja brez elektrike. Vse naprave več ali manj potrebujejo za zagon električno energijo, tako v gospodarstvu kot v družbi kot celoti. Energetika dejansko predstavlja eno od najpomembnejših infrastrukturnih dejavnosti. Zaradi vedno večje porabe električne energije in s tem posledično povečanju zanesljivosti preskrbe z njo, je sistemski operater elektroenergetskega omrežja, v skladu s slovensko energetsko zakonodajo, zaupana skrb za načrtovanje, graditev in posodabljanje slovenskega visokonapetostnega prenosnega omrežja. S tem se sistemski operater srečuje s pravno regulativo, katera je vedno bolj obsežna in zahtevna. Pri tem, da je postopek pridobitve gradbenega dovoljenja za cca. 80 km daljnovod tudi do deset let, je potrebno poudariti, da se uradniki premalo zavedajo, da lahko pride, zaradi zgoraj naštetih dejstev, kaj kmalu do električnega mrka. Sistemski operater mora za vsakega lastnika nepremičnine v koridorju daljnovoda skleniti služnostno pogodbo v javno korist. Služnost v javno korist pomeni omejevanje lastninske pravice. Teh služnostnih pogodb je za 80 km daljnovod približno dva tisoč. In tu je ključni problem sistemskega operaterja pridobiti vse te služnostne pogodbe v javno korist, zaradi še vedno neurejenih zemljiškoknjižnih zadev iz uradnih evidenc.

Title:Transmission line right of way legislation performed by transmisson system operator
Abstract:The more versatile usability of electricity of nowadays requires new investments in energy infrastructure. We know that electricity can not be stored to be used later. Repeatedly we hear that the citizens of this planet can not imagine life without electricity. More or less all devices need electricity to start running, both in the business and the in society as a whole. Energy industry in fact represents one of the most important infrastructural sectors. Due to the increasing electricity consumption and thus increased need for security of electricity suppy, the System Operator of the electricity network has been entrusted in accordance with the Slovenian energy legislation with care of the planning, construction and modernization of Slovenian high-voltage transmission network. As a result, the System Operator is facing increasingly complex and demanding legal regulations. Noting that the process of obtaining a building permit for an approx. 80 km-long power line can take up to ten years, it is necessary to emphasize that the officials are insufficiently aware that soon an electrical blackout may ensue. The System Operator must conclude an easement contract in the public interest with every property owner in the corridor of the transmission line. Easement in the public interest constitutes a restriction of property rights. For an 80 km-long transmission line, there are approximately two thousand of such easement contracts. Herein lies the key problem of the system operator: to conclude all of the easement contracts in the public interest because there are the still unsettled affairs in official records from Land Registry.
