Title:ODTUJITEV STVARI, O KATERI TEČE PRAVDA

Abstract:Stvar ali pravica, o kateri teče pravda, je lahko predmet pravnoposlovnih razpolaganj, kar pomeni, da lahko stranka, (tožeča ali tožena) sporno stvar ali pravico med pravdnim postopkom proda oziroma odstopi. Takšno dejanje pa ni nepomembno z vidika pravdnega postopka ter z vidika pravdnih strank. Da bi se izognili nepotrebnemu podvajanju in zavlačevanju postopkov v takšnih primerih, je civilno procesno pravo razvilo posebno pravilo, na podlagi katerega odtujitev stvari ali pravice med postopkom ne vpliva na njegovo dokončanje. Civilni pravdni postopek se bo torej kljub odtujitvi sporne stvari ali pravice lahko zaključil med istima pravdnima strankama, kot se je začel. Argumentiranje tega splošnega pravila je povezano s poznavanjem razlike med stvarno in procesno legitimacijo. Z odtujitvijo stvari ali pravice pravdne stranke namreč zgubijo zgolj stvarno legitimacijo, kar pomeni, da pravdna stranka, ki je stvar odtujila, ni več nosilka pravic in obveznosti iz materialnopravnega razmerja. Pravdne stranke pa zaradi odtujitve sporne stvari ali pravice ne izgubijo procesne legitimacije, zaradi česar se lahko pravda konča med istima osebama, kot se je začela. Ključna posledica odtujitve stvari oziroma pravice, o kateri teče pravda, je torej naknadna ločitev procesne in stvarne legitimacije. Zelo pomembni so tudi pravni učinki uporabe tega pravila v praksi, ki se kažejo v vprašanju spremembe pravdnih strank in v vprašanju spremembe tožbenega zahtevka. Zlasti ti dve vprašanji sta v praksi in teoriji predmet številnih obravnav, saj spadata med izjemno kompleksna in sporna vprašanja.

Title:DISPOSAL OF THINGS, RUN BY LAWSUIT
Abstract:The entity or the right concerned in the law suit can be subjected to legally-commercial disposal, which means that the party (plaintiff or defendant) is able to sell or withdraw the right or the item in question during contentious proceedings. Such act is not irrelevant to contentious proceedings or the view of litigating parties. In order to avoid unnecessary duplication and delay of proceedings in such cases, the civil law has developed a special rule on the basis of which the disposal of entity or right during the proceedings does not affect its outcome. The civil contentious proceedings will therefore be concluded between the same two litigating parties between which it began. The argument of this general rule is linked to the difference between legitimation of cause (legitimatio ad causam) and legitimation of cause (legitimatio ad processum). By disposing the entity or the right, the litigating parties lose only legitimatio ad causam, which means that litigating party, who disposed the entity, no longer carries the rights and obligations of the substantive law relationship. The litigating parties do not lose legitimatio ad processum due to the disposal of the entity or the right in question. Therefore, the law suit can be concluded between the same parties that it began. The key consequence of the disposal of the item or the right in question is subsequent separation of legitimatio ad causam and legitiomatio ad processum. Furthermore, the legal affects of the usage of this rule in practice are of high importance, since they are shown in the question of litigating parties changes and in the question of civil claim changes. Those two questions are subject of numerous hearing procedures in practise and in theory, since they are considered to be extremely complex and problematic.
