Abstract:
Diplomsko delo predstavi možne postopke in načine predsodne in sodne izterjave ter spopadanje s problemom neplačništva. Natančno obravnava celotni izvršilni postopek in možnosti za izterjavo. V drugem delu obravana pogoje za začetek stečaja in sam stečajni postopek. Predstavijo se prednosti in slabosti izvršilnega in stečajnega postopka z vidika prezadolžene fizične osebe. Za prezadolženega dolžnika se prikaže, kdaj in zakaj je potrebno začeti stečajni postopek in kakšne so posledice ter prednosti, ki jih prinaša.

ENFORCEMENT AND BANKRUPTCY PROCEEDINGS FROM THE PERSPECTIVE OF THE INSOLVENT DEBTOR
Abstract:
The thesis presents the possible procedures and methods of the pre-trial proceeding and judicial proceeding due to problems with late or none payment. The thesis presents precisely the entire enforcement process and the possibility of recovery. In the second part the thesis presents conditions for the opening of bankruptcy proceedings and bankruptcy proceedings alone. Proceedings with its advantages and disadvantages are presented from the point of view of over-indebted individuals. In the thesis there is displayed when and why it is necessary to start bankruptcy proceedings and what are the implications and the benefits that it brings.
