Title:KOLEKTIVNI ODPUSTI V LUČI NOVEJŠE SODNE PRAKSE EU

Abstract:Z nastankom gospodarske krize, tako v slovenskem gospodarstvu kot v gospodarstvu drugih držav članic Evropske unije, se je močno povečalo število prenehanj gospodarskih družb in s tem število rednih odpovedi pogodb o zaposlitvi iz poslovnega razloga. V takih razmerah se gospodarske družbe srečujejo s številnimi delovnopravnimi vprašanji, med katerimi se pogosto pojavlja tudi vprašanje, kako mora delodajalec postopati ob odpovedi večjemu številu delavcev iz poslovnih razlogov oziroma pri kolektivnih odpustih. Delovna zakonodaja namreč za postopek kolektivnih odpustov predpisuje dodatne obveznosti delodajalca ter s tem posledično dodatne pravice delavcev. Kolektivni odpusti so na ravni Evropske unije urejeni z Direktivo 98/59 o kolektivnih odpustih, v slovenskem pravnem redu pa so po njenem vzoru urejeni v Zakonu o delovnih razmerjih, v členih od 98 do 103. V magistrskem delu so najprej predstavljeni nacionalni pravni viri in mednarodni pravni viri, ki predstavljajo ključno izhodišče za oblikovanje slovenske zakonodaje. Nadalje je podrobneje predstavljena pravna ureditev kolektivnih odpustov tako na ravni Evropske unije kot na nacionalni ravni. Pri tem je vključena slovenska sodna praksa in sodna praksa Sodišča EU. Sodna praksa Sodišča EU je za obravnavno temo zelo pomembna, saj iz nje izhajajo pomembne interpretacije posameznih določb Direktive 98/59 o kolektivnih odpustih, ki jih morajo upoštevati vse države članice Evropske Unije, torej tudi Republika Slovenija. Prav tako Sodišče EU v svojih sodbah podaja široko opredelitev posameznih pojmov, katerih namen je zagotoviti uporabo Direktive 98/59 o kolektivnih odpustih čim širšemu krogu delavcev v postopku kolektivnih odpustov. V magistrskem delu bodo zato predstavljeni predvsem tisti pojmi, oziroma pravna vprašanja, ki se tičejo razlage Direktive 98/59 o kolektivnih odpustih in so bila obravnavana v sodbah Sodišča EU, saj pomembno vplivajo na razumevanje obravnavane teme. Na koncu je predstavljena tudi nemška pravna ureditev kolektivnih odpustov.

Title:COLLECTIVE REDUNDANCIES IN THE LIGHT OF THE RECENT CASE LAW OF THE EUROPEAN UNION
Abstract:Since the Slovenian economy as well as economies of other members of the European Union were hit by the economic crisis, winding up of undertakings and hence the number of regular terminations of employment contracts on commercial grounds has sharply increased. In such a situation, undertakings are faced with numerous issues pertaining to labour law that often include the question on how should an employer proceed in the case of terminating the contract of a larger number of employees on commercial grounds, or collective redundancies. In the case of the collective redundancies procedure, labour legislation imposes additional obligations on the employer and consequently brings additional rights for employees. At the European Union level, collective redundancies are governed by the Directive 98/95, whereas in the Slovenian acquis they are regulated in the Employment Relationships Act in Articles 98 to 103, following the European model. This master’s thesis first provides a presentation of national sources of law and international sources of law, which represent the key starting point for the development of the Slovenian legislation. This is followed by a thorough presentation of legal regime of collective redundancies at the European Union and national levels. The case-laws of Slovenia and the Court of Justice of the European Union are also included. The latter is of high importance for the chosen subject as it is the main source of all important interpretations of specific provisions of the Directive 98/59 on collective redundancies that all Member States must respect, the Republic of Slovenia thus as well. Furthermore, in its judgements, the Court of Justice of the European Union gives a broad definition of specific terms with the goal of ensuring the application of the Directive 98/59 on collective redundancies in the collective redundancies procedure for as many employees as possible. This master’s thesis therefore details predominantly those terms and legal questions that are related to the interpretation of the Directive 98/95 on collective redundancies and that were at issue in the judgements of the Court of Justice of the European Union, for they have a significant effect on the understanding of the chosen subject. Lastly, the German collective redundancies legislation is presented.
