Title:Pridržanje po določilih Zakona o pravilih cestnega prometa : diplomsko delo visokošolskega strokovnega študija Varstvoslovje

Abstract:Dejstvo, da je v Republiki Sloveniji najpogostejši vzrok za prometne nesreče neprilagojena hitrost, s katero je mnogokrat povezana tudi vožnja pod vplivom alkohola, prepovedanih drog in drugih psihoaktivnih snovi, pove, da je za izboljšanje prometne varnosti treba vzpostaviti učinkovit sistem, ki bo omogočal ukrepanje zoper voznike, ki vozijo pod vplivom alkohola in tako ogrožajo druge udeležence v cestnem prometu. Eno od teh je vsekakor tudi pridržanje alkoholiziranega voznika. V diplomskem delu bomo predstavili spremembe zakonodaje s tega področja in njihov vpliv na odnos do zagotavljanja višjega nivoja človekovih pravic in svoboščin. Pridržanje namreč predstavlja korenit poseg v človekove pravice, zato je pri izvajanju le-tega, zelo pomembno dobro poznavanje zakonskih predpisov in vseh ostalih pogojev za uporabo tega policijskega pooblastila. Podrobno bomo analizirali ukrep pridržanja po 238b. členu Zakona o varnosti v cestnem prometu (ZVCP-1), ga primerjali s trenutno veljavnim ukrepom pridržanja po 24. členu Zakona o pravilih cestnega prometa (ZPrCP) in prikazali, v čem se omenjena ukrepa razlikujeta, ter kateri od ukrepov je, glede na stopnjo posega v pravico do osebne svobode, primernejši. Predstavili bomo tudi določila 22. in 23. člena ZPrCP, ki urejata prepoved vožnje, začasen odvzem vozniškega dovoljenja in zaseg motornega vozila, ter se hkrati navezujeta tudi na pooblastilo pridržanja. V diplomskem delu bomo opisali tudi sistem nadzora izvajanja pridržanj, ki je zaradi grobega posega v človekove pravice in svoboščine nujno potreben. Sprememba zakonodaje s področja policijskega pridržanja po določilih Zakona o pravilih cestnega prometa, s katerim je predpisana možnost odstopa od pridržanja, se je vsekakor približala višjemu standardu spoštovanja človekovih pravic in svoboščin. Ne glede na ugotovitve se nam, glede na splošno predpisano področje pridržanja alkoholizirane osebe v Zakonu o prekrških, poraja vprašanje, ali je ureditev lex specialis s področnim zakonom sploh potrebna.

Title:DETENTION REGULATION IN ACCORDANCE WITH THE ACT OF RULES IN ROAD TRANSPORT
Abstract:The fact that speeding, with which also drunk driving, driving under the influence of illegal drugs and other psychoactive substances are often associated with, is the most frequent cause of traffic accidents in the Republic of Slovenia says that an effective system, which will enable to take action against drivers who drive under the influence of alcohol and thus endanger other road users, needs to be established in order to improve traffic safety. Detention of drunk drivers is certainly also one of these measures. The diploma paper will present amendments to legislation in this field and their impact on the relationship to the provision of a higher level of human rights and freedoms. Detention namely presents a radical encroachment on human rights and for this reason it is very important to know well statutory provisions and all other conditions for the use of this police power for its implementation. We will analyse in detail the measure of detention under Article 238 of the Road Traffic Safety Act (ZVCP-1), compare it with the currently applied measure of detention under Article 24 of the Act of Rules in Road Transport (ZPrCP), and show how the above-mentioned measures differ and which of the measures is more appropriate regarding the level of infringement of the right to personal liberty. We will also present the provisions of Articles 22 and 23 of the ZPrCP, regulating driving ban, suspension of a driving licence and seizure of a motor vehicle, while they also relate to the power of detention. The diploma paper will also describe the monitoring system of the implementation of detentions, which is indispensable due to rough encroachment on human rights and freedoms. The amendment to legislation in the field of police detention according to the provisions of the Act of Rules in Road Transport, which lays down the possibility of withdrawal from detention, certainly approximated to higher standard of respect for human rights and freedoms. Notwithstanding the conclusions, the question that arises is whether the »lex specialis« regulation with a sector-specific law is needed at all in relation to the generally prescribed sector of detaining a drunk person in the Minor Offences Act.
