Abstract:Javna naročila so skupek dejanj, ki jih naročniki opravijo s ciljem gospodarne nabave blaga, storitev ali gradbenih del. K izvajanju javnih naročil so zavezani posredni in neposredni uporabniki državnega proračuna in lokalnih proračunov. Cilj javnih naročil je doseči kar najbolj gospodarno porabo javnih sredstev. Na področju storitev čiščenja poslovnih prostorov se ponudniki pri javnih naročilih pogosto srečujemo s problemom merila najnižje cene. ZJN-2 omogoča naročnikom dve meril: merilo ekonomsko najugodnejše ponudbe in merilo najnižje cene. Naročniki se prepogosto odločajo za izbor merila najnižje cene, saj je za naročnika, ki pripravlja dokumentacijo javnega naročila, najbolj preprosto in varno merilo. Tako mu ni treba zagovarjati in tehtati dodatnih pogojev, povezanih s kvaliteto izvedbe del. Ponudniki se zaradi pridobitve posla zatekajo k vedno nižjim cenam za storitve, kar pa vodi v nekakovostno opravljanje storitev, neizpolnjevanje delovnopravne zakonodaje, izkoriščanje delavcev, nekatera podjetja se soočajo tudi s prisilno poravnavo ali stečajem. Hkrati ponudniki tudi pozabljajo osnovno načelo gospodarskih družb, ki je zapisano v 1. členu Zakona o gospodarskih družbah: gospodarska družba je pravna oseba, ki na trgu samostojno opravlja pridobitno dejavnost kot svojo izključno dejavnost.

Title:PUBLIC PROCUREMENT
Abstract:Public procurement is a set of actions carried out by the contracting authority with the aim of economical purchase of goods, services or works. The implementation of public tenders is subject to direct and indirect users of state and local budgets. The aim of the procurement is to achieve as much efficient use of public funds as possible. In the field of cleaning services for business premises, providers in public procurement often are faced with the problem of the lowest price criterion. ZJN-2 allows the following two criteria to contracting authorities: the most economically advantageous tender criterion and the lowest price criterion. The contracting authorities often opt for the lowest price criterion, since it is the simplest and safest criterion for the contracting authority preparing public procurement documentation. Thus, it is not necessary to defend and weigh additional conditions relating to the quality of work implementation. Due to the acquisition of business, the providers resort to increasingly lower prices for services, which leads to poor quality services, incompliance with labour and statutory legislation, exploitation of workers, some companies are also faced with forced settlement or bankruptcy. At the same time, providers are forgetting about the basic principle of companies, which is written under Article 1 of the Companies Act: Company is a legal person who independently carries out gainful activity on the market as its exclusive activity.
