Abstract:Disciplinski ukrepi morajo biti izvedeni v skladu z zakonom in po postopku, ki ga le ta predvideva. Poleg zakonitosti postopka pa morajo v podjetjih obstajati tudi lastni pravilniki, ki to področje interno urejajo. Vodenje pravilnih postopkov in izrekanje ukrepov podjetja zna biti zahtevno, vendar nujno, da se delodajalci izognejo kršitvam zakona in morebitnim odškodninskim tožbam. Discipliniranje delavcev, ki dela ne opravljajo dobro, pa je nujno za doseganje dobrih poslovnih rezultatov podjetja. Seveda pa se te ukrepi ne smejo zlorabljati za izkoriščanje delavcev in poseganja v delavske pravice. Zato so v ta namen predpisana pravila in ustrezne zakonske ureditve, da delodajalcu omeji preveč subjektivno in samovoljno uporabo disciplinske oblasti. Delodajalci pa se pogosto znajdejo v položajih, ko od svojih zaposlenih zahtevajo upoštevanje določenih navodil in pravil, dolžnost zaposlenih pa je le ta upoštevati dokler so zakonita in v skladu z pogodbo o delovnem razmerju. Vendar se kjub temu dostikrat zgodi, da delavec ne upošteva njegovih navodil in je tako delodajalec prisiljen uporabiti določene zakonske ukrepe.

Title:DISCIPLINARY RESPONSIBILITY OF A WORKER
Abstract:Disciplinary actions must follow legal procedures witch are in accordance with Slovenian law.  Besides following the lawful procedures each company must have its own internal rulebook on managing disciplinary actions. Management and execution of these procedures can be demanding work, but necessary in order for the employer to avoid braking the law and subsequent lawsuits. Workers, whose conduct at their workplace is not professional, have to be disciplined in order to help companies avoid damage to their business. It is very important that these rights are not abused by the companies against workers’ rights. The purpose of rules and regulations in this field is to prevent abuse of these disciplinary actions for personal reasons and gains by those with the power to use them. Companies often find themselves in a situation in which they need the workers to follow certain rules and regulations, and the workers are obligated to follow them as long as they are legal and in accordance to their work contract. But it often happens that the companies are forced to use certain types of disciplinary actions, because workers do not follow instructions.
