Title:PRIKRITI POSEG V INFORMACIJSKE SISTEME KOT MOŽEN PRIKRITI PREISKOVALNI UKREP

Abstract:Diplomska naloga ureja prikaz osnovnih pojmov s področja informacijskih tehnologij. Posebej je poudarjeno razlikovanje med elektronskimi napravami in informacijskimi sistemi ter med elektronskimi podatki in digitalnimi podatki. Na podlagi teh opredelitev je predlagan razmislek o spremembi instituta preiskovanja elektronskih naprav tako, da se kot osrednji objekt preiskovanja določi informacijski sistem. Opredelitev kibernetske kriminalitetete temelji na pojavnih oblikah tistih kaznivih dejanj, kjer so elektronske naprave njihov prevladujoči element, sicer kot predmet napada, sredstvo storitve ali zgolj kot nosilec iskanih vsebin. Gibanje kibernetske kriminalitete čez čas je predstavljeno s podajo statističnih podatkov. Na podlagi proučitve osnovnih struktur kibernetskega prostora, pojavnih oblik kaznivih dejanj kibernetske kriminalitete, pomanjkljivosti obstoječega instituta preiskave elektronskih naprav ter drugih preiskovalnih dejanj je v nalogi ugotovljeno, da ni zagotovljen zadostni kazenskopravni okvir niti za pregon osnovnih oblik kibernetske kriminalitete. Institut prikritega posega v informacijske sisteme po tej ugotovitvi nesporno predstavlja enega od primernejših ukrepov pri našem soočanju z izzivi informacijske družbe na kazenskopravnem področju.

Title:COVERT INTERVENTION OF INFORMATION SYSTEMS AS A POSSIBLE UNDERCOVER INVESTIGATIVE MEASURE
Abstract:This thesis presents and provides short overview of the basic concepts in the field of information technologies. Specifically it highlights the distinction between electronic devices and information systems as well as between electronic data and digital data. In addition to these distinctions a reference to possible legislative amendments concerning the legal institute on the investigation of electronic device is pointed out in a way that the information system becomes the central object of investigation. Determination of cybercrime is based on those criminal offences, in which the electronic devices are their main elements either as the object of attack, mean of the offence or as a carrier of searched content. Throughout the statistical data the development (movement) of cybercrime over the time is presented. Finally this theses conclude by analysing the basic structures of cyberspace, different forms of cybercrime offences, existing institute on investigation of electronic devices as well as other investigative actions that existing legislative and regulatory frame is not efficient framework for the prosecution of cybercrime offences. The institute of covert operation with intervention to information systems is probably the most appropriate action in facing challenges of information society in the field of criminal law.
