Title:KOLEKTIVNO DOGOVARJANJE S POUDARKOM NA KOLEKTIVNI POGODBI ZA POLICISTE

Abstract:Kolektivne pogodbe so zelo učinkovito sredstvo za urejanje delovnih pogojev, razmerij med socialnimi partnerji, določitev plače in minimalnih standardov, ki ne smejo zniževati pravic delavcev določenih v zakonskih predpisih. Sistem sklepanja kolektivnih pogodb je svoboden in prostovoljen, kar je tudi eno izmed temeljnih načel kolektivnega dogovarjanja. Postopek sklepanja kolektivnih pogodb zajema opredelitev strank kolektivnih pogajanj, proces pogajanja, ter registracijo in objavo sklenjene kolektivne pogodbe v Uradnem listu. Na teh načelih sloni tudi Zakon o kolektivnih pogodbah, kateri ne predpisuje obveznega sklepanja kolektivnih pogodb niti ne predpisuje obvezne sestavine. Vse to pomeni, da obstaja avtonomija pogodbenih strank, katere lahko svobodno urejajo medsebojna delovno pravna razmerja. Obstaja pa tudi omejitev avtonomije kolektivnih pogajanj, vendar to le v primeru, ko bi šlo za omejevanje zaradi zagotavljanja ali varstva pravic drugih. Takšno omejitev pa lahko določi le Ustava ali zakon. Zakon o sistemu plač v javnem sektorju je to svobodo omejil saj je v 13. členu predpisal, da se ovrednotena orientacijska delovna mesta in nazivi uvrstijo v plačne razrede določene v kolektivni pogodbi za javni sektor oz. v kolektivni pogodbi dejavnosti, ne pa tudi v panožni kolektivni pogodbi kot je Kolektivna pogodba za policiste . Policisti in kriminalisti so na podlagi Kolektivne pogodbe za javni sektor uvrščeni v plačno podskupino C3 in sicer v 21 plačni razred kar pomeni, da je njihovo delo pod vrednoteno saj so obravnavani enako kot vojaki, cariniki, pazniki in izterjevalci ter referenti na upravnih enotah. Navedena določba zakona tako preprečuje ureditev plače (tarifni del kolektivne pogodbe) policistov v Kolektivni pogodbi za policiste. Rešitev se kaže v morebitni pripravljenosti politike (delodajalca, t.j. Vlade RS) za spremembo zakonodaje, ki bi omogočala ureditev plačnega sistema za policiste v panožni kolektivni pogodbi pri čemer bi se lahko upoštevale vse specifičnosti dela policista.

Title:COLLECTIVE BARGAINING WITH THE EMPHASIS ON THE COLLECTIVE AGREEMENT FOR POLICE OFFICERS
Abstract:Collective agreements are a very effective instrument for processing working conditions, relations among social partners, determination of wages and minimum standards, which cannot lower workers' rights well-defined by statute. The system of concluding collective agreements is unrestrained and voluntary, which is one of the fundamental principles of collective negotiations. The process of concluding collective agreements includes the definition of the clients of the collective negotiations, the process of negotiation, and registration and publication of concluded collective agreement in the Official Gazette. The Law of collective agreements is also based on these principles, and it does not dictate a mandatory conclusion of the collective agreements, neither does it dictate a mandatory component. All that means that there is an autonomy of the contracting parties, who can freely govern mutual labour legal relations. Restriction of the autonomy of collective negotiations also exists, but only in the event when restriction would happen for the provision or protection of the rights of others. Such limitation can only be determined by the Constitution or the law. The law on wage system in the public sector has limited this freedom for it stated in Article 13 that the evaluated policy work places and titles shall be included in income classes specified in the collective agreement for the public sector or in activities collective agreement, but not in interindustry collective agreement as is Collective agreement for police officers. Police officers and criminal investigation officers are, on the grounds of Collective agreement for the public sector, listed under income subgroup C3, namely in 21 income class, which means that their work is undervalued for they are treated on identical terms as soldiers, custom officers, prison officers, repo men and clerical officers at administrative units. The above mentioned law provision prevents income regulation (tariff part of collective agreement) of police officers in Collective agreement for police officers. Solution appears to be in the possible preparedness of the politics (employer, so-called Government RS) for the amendment of legislation which would allow regulation of the wage system for police officers in interindustry collective agreement. In doing so, all the specificities of the work of a police officer would be taken into account.
