Title:VPLIV RAZMERIJ IN RAZLIK MED PRAVOM EU IN SODNO PRAKSO ESČP NA ZAGOTAVLJANJE SODNEGA VARSTVA PRED SLOVENSKIMI SODIŠČI V AZILNIH ZADEVAH

Abstract:Namen instituta azila je zaščititi posameznika, ki iz določenega razloga ne uživa zaščite svoje matične države. Azil v kontekstu te naloge pomeni status begunca po Ženevski konvenciji iz leta 1951 oziroma po Kvalifikacijski direktivi II o standardih glede pogojev, ki jih morajo izpolnjevati državljani tretjih držav ali osebe brez državljanstva, da so upravičeni do mednarodne zaščite, glede enotnega statusa beguncev ali oseb, upravičenih do subsidiarne zaščite. Obe obliki zaščite - status begunca in subsidiarne zaščite - predstavljata institut mednarodne zaščite po pravu EU. Eno bistvenih vprašanj skupnega evropskega azilnega sistema je, kako se zagotavlja sodno varstvo te temeljne pravice. Pravica do učinkovitega sodnega varstva je namreč ključno pravno zagotovilo za varstvo pravic prosilcev za azil. Če pravni red priznava neko pravico, mora zagotavljati tudi pravico do njenega učinkovitega varstva in le učinkovit sodni sistem lahko zagotovi uresničevanje določene pravice posameznika. Izhodiščni mednarodno-pravni problem, ki je predmet obravnave v prvem delu naloge, je ta, da področje azila v Evropi urejajo trije bolj ali manj samostojni, ki pa so do neke mere tudi različni pravni sistemi: pravo EU, sodna praksa ESČP v zvezi s EKČP in nacionalno pravo na ravni zakona in ustave. Dejstvo prepletenosti treh sistemov in medsebojnih razlik vzpostavlja visoko stopnjo pravne kompleksnosti in to je predmet obravnave in ponazoritve v 3. in 4. poglavju naloge. Naloga se omejuje na področje dostopa do azilnega postopka in ugotavljanja pogojev za mednarodno zaščito, vključno s pridržanjem prosilcev za azil. Za potrebe te naloge pravna kompleksnost omenjenih treh sistemov služi kot neodvisna spremenljivka, za katero se lahko utemeljeno sklepa, da ima zaznaven vpliv na kakovost sodne prakse pred slovenskimi sodišči, čemur je namenjen drugi del naloge. Slednje je v nalogi odvisna spremenljivka. Kakšen je ta vpliv, je predmet analize na podlagi pregleda sodnih odločb Ustavnega sodišča, Vrhovnega sodišča in Upravnega sodišča Republike Slovenije.

Title:The Influence of Relations and Differences between EU Law and the Jurisprudence of the European Court of Human Rights on the Provision of Judicial Protection at Slovenian Courts of Justice in Asylum Matters
Abstract:The purpose of asylum is to protect individuals who, for some reason, do not enjoy the protection of their country of origin. In the present thesis, asylum means the refugee status under the 1951 Geneva Convention and Qualification Directive II on standards for the qualification of third-country nationals or stateless persons as beneficiaries of international protection, for a uniform status for refugees or for persons eligible for subsidiary protection, and for the content of the protection granted, respectively. Both forms of protection – the refugee status and the subsidiary protection status – constitute institutions of international protection under EU law. A key question of the Common European Asylum System is how to ensure the judicial protection of this fundamental right. The right to effective judicial protection is an essential element of the protection of the rights of asylum seekers. If the legal order recognises a certain right, it must also guarantee the right to its effective judicial protection. Only an effective judicial system can guarantee the realisation of the individual’s rights. In the first part, the thesis deals with the fact that the right to asylum in Europe is covered by three relatively independent and different legal systems: EU law, the jurisprudence of the European Court of Human Rights is connection with the ECHR and national (constitutional) law. The combination of the three systems and their differences has created an immense legal complexity, which is discussed in chapters 3 and 4. The thesis focuses on the access to the asylum procedure and qualification standards for international protection, including the detention of asylum seekers. The legal complexity of the three legal systems serves as an independent variable, which is justifiably believed to have a considerable influence on the quality of the jurisprudence of Slovenian courts of justice. The second part of the thesis analyses the jurisprudence of Slovenian courts of justice, which is a dependant variable. This influence is analysed on the basis of decisions by the Constitutional Court, the Supreme Court and the Administrative Court of the Republic of Slovenia.
