Title:PRAVNO VARSTVO DELAVCEV ZARADI NOSEČNOSTI IN STARŠEVSTVA MED TEORIJO IN PRAKSO

Abstract:Časi, ko so ženske doma skrbele za otroke, moški pa so bili hranitelji družine, so že zdavnaj minili. Danes je nekaj običajnega, da dohodek, od katerega družina živi, pridobivata oba starša, ob tem pa enakopravno prevzemata skrb za nego in razvoj otrok. Starševstvo v današnjem času predstavlja za zaposlena starša velik izziv, saj morata oče in mati po rojstvu otroka uskladiti družinske in poklicne obveznosti, na trgu dela in na delovnem mestu pa se lahko predvsem noseče delavke soočijo tudi z različnimi oblikami diskriminacije. Zaradi posebnega položaja delavcev v tem življenjskem obdobju je zato naša država enako kot druge razvite države nosečim delavkam in staršem namenila posebno varstvo. V diplomskem delu predstavljamo in razčlenjujemo pravne vire z delovno-pravnega področja, ki urejajo varstvo nosečnih delavk in staršev v Sloveniji in najpomembnejše mednarodne dokumente, ki so podlaga za ureditev tega področja v naši državi. Podrobneje predstavljamo pravice, ki so staršem in nosečim delavkam v Sloveniji zagotovljene v okviru posebnega varstva, ureditev materinskega, očetovskega in starševskega dopusta v Sloveniji pa primerjamo tudi z ureditvijo v drugih državah članicah Evropske unije. Pomemben del diplomskega dela namenjamo raziskovanju kršitev in uveljavljanju pravic delavcev, ki so deležni posebnega varstva zaradi nosečnosti in starševstva.

Title:LEGAL PROTECTION OF WORKERS DUE TO PREGNANCY AND PARENTHOOD IN THEORY AND PRAXIS
Abstract:The times when women stayed at home and took care of the children while the men were the main bread winners, are long gone. Nowadays it's completely normal for both parents to be employed and share the responsibilities of child care and development on an equal basis. Thus parenthood presents an enormous challenge, since the parents must reconcile their family and professional lives. Particularly pregnant women may encounter various forms of discrimination at their workplace as well as in the labour market in general. Because of the special needs of workers in this sensitive period of life our governement has, as other developed countries, introduced special protection to alleviate these issues. In the following work we present and analyze labour legislation, particularly the part which deals with protection of pregnant workers and parents in Slovenia, as well as the crucial international legal documents which form the basis for regulation in our country. We present in detail the rights provided to parents and pregnant workers within the framework of special protection laws, maternity, paternity, and parental leave in Slovenia, and make a comparison with other EU member states. Special attention is dedicated to the research of violations of these rights, as well as the enforcement of workers rights who fall under the special protection legislation due to pregnancy and parenthood.
