Title:Postopek hišne preiskave - res zgolj tehnologija? : specialistično delo podiplomskega študija kriminalističnega preiskovanja

Abstract:Institut hišne preiskave močno posega v ustavno zagotovljene človekove pravice do zasebnosti, zato že Ustava Republike Slovenije (Ustava RS) določa pogoje, pod katerimi je takšen poseg v posameznikovo zasebnost dopusten. Konkretneje ta institut ureja Zakon o kazenskem postopku (ZKP), ki določa tako vsebinske kot formalne pogoje za izvedbo hišne preiskave, potek hišne preiskave, ureja pravice osebe, pri kateri se hišna preiskava opravlja, navzočnost določenih oseb pri hišni preiskavi ter protokolacijo opravljene hišne preiskave in zaseženih predmetov. Odgovore na vprašanja, ki so se pri izvedbi hišne preiskave v praksi izpostavili, predstavlja sodna praksa, in sicer tako glede specifičnih prostorov, ki naj se preiščejo (sefa, nočne omarice, zapuščenih prostorov, odvetniške pisarne, sedeža politične stranke in državnega zbora), kot tudi glede oseb, ki sodelujejo pri hišni preiskavi oziroma pri katerih se opravlja; nadalje vsebine odredbe o hišni preiskavi, vprašanja dokaznega standarda ter razlike med ogledom in hišno preiskavo, med pregledom prevoznih sredstev, prtljage in potnikov ter preiskavo, vprašanja kaj je skriti prostor in kaj spada pod izraz stanovanje in drugi prostori, ki naj se preiščejo. Vsa ta vprašanja, ki so se izpostavila tekom uporabe instituta hišne preiskave nakazujejo, da pri hišni preiskavi res ne gre zgolj za tehnologijo, temveč za hud poseg v človekovo pravico do nedotakljivosti stanovanja in do pričakovane zasebnosti zato mora biti tak poseg sorazmeren, utemeljen in zakonit.

Title:Postopek hišne preiskave - res zgolj tehnologija
Abstract:A house investigation procedure seriously infringes the constitutional right to privacy. For this reason the conditions, under which such interference with the privacy of an individual is allowed, are already stipulated in the Constitution of the Republic of Slovenia. More specifically the respective procedure is governed by the Criminal Procedure Act (ZKP) which stipulates substantive as well as formal conditions to carry out a house investigation, the course of investigation, governs the rights of a person, with who the house investigation is performed, the presence of specific persons at the house investigation, and the official record of the conducted house investigation and seizure of objects. Answers to the questions posed in relation to the house investigation in practice are given in case-law, namely in terms of specific premises to be searched (safe, bedside table, empty rooms, law firm, head office of a political party and the National Assembly) as well as persons who participate or are included in the house investigation, search warrant content, questions related to the evidentiary standard and differences between the examination and house investigation, between the examination of the means of traffic, luggage and passengers and the investigation, the questions of what is a hidden place and what falls under the term 'home and other premises' that are to be searched. All these issues raised during the application of the house investigation procedure indicate that the house investigation is not only about the technology, but also a serious infringement of the right to the inviolability of the home and to the expected privacy. And for this reason the infringement must be proportionate, substantiated and lawful.
