Title:IZKLJUČITVENA TOŽBA

Abstract:Z diplomskih delom podrobno predstavim izključitveno tožbo. Gre za relativno mlad pravni institut, ki ga je v naš pravni sistem uvedel Stvarnopravni zakonik. V 123. členu določi, da lahko etažni lastniki, ki imajo več kot polovico solastniških deležev na skupnih delih, sprejmejo sklep, da se kršitelja opomni, če etažni lastnik ali drug uporabnik posameznega dela v etažni lastnini, grobo krši temeljna pravila sosedskega sožitja ali svoje dolžnosti po pogodbi o medsebojnih razmerjih, tako, da je skupnost z njim nevzdržna. V kolikor kršilec kljub opominu nadaljuje s svojim ravnanjem, lahko etažni lastniki, ki imajo več kot polovico solastniških deležev na skupnih delih, sprejmejo sklep, da se vloži tožba za njegovo izključitev in prodajo njegovega posameznega dela. Skozi delo podrobno opišem namen in bistvo instituta ter kateri predpisi ga določajo. Predstavim celoten postopek, ki je potreben, da se izključitvena tožba realizira s prodajo posameznega dela etažne lastnine kršitelja in njegovo izselitvijo. Za primerjavo opišem, kako je izključitvena tožba urejena v nekaterih drugih evropskih državah. S pomočjo sodne prakse in zakonodaje podam konkretne razloge, oziroma ugotovim, katere so tiste hujše kršitve, ki so razlog za vložitev tožbe. Tožba se realizira s prodajo posameznega dela etažne lastnine kršilca in njegovo izselitvijo, kar je velik poseg v lastninsko pravico, zato je izključitvena tožba pravno sredstvo, ki se ga uporabi le kot skrajni ukrep in ko druga pravna sredstva niso mogoča. V delu izključitveno tožbo primerjam z alternativnimi pravnimi možnosti, ki veljajo za milejši pravni ukrep in obenem dosežejo ponovno sožitje med prebivalci v večstanovanjskem bloku.

Title:EXCLUSIONARY ACTION
Abstract:My thesis is an attempt to describe exclusionary action in detail. This is a relatively new legal instrument introduced to our legal system by the Law of Property Code. Article 123 stipulates that property owners with more than one half of joint property may adopt a decision to caution the offender, if a property owner or another user of joint property should gravely violate fundamental rules of cohabitation between neighbours or their obligations arising from the Agreement on Mutual Relations making cohabitation intolerable. If in spite of this warning the offender should persist in such behaviour, property owners with more than one half of joint property may adopt a decision to take legal action for their eviction and the sale of their individual share in the property. In my theses I describe in detail the purpose and essence of this instrument, and which regulations provide the instrument. I present the entire procedure required for exclusionary action to take place by selling the offender’s individual share in the property and evicting them. For comparison, I describe the application of exclusionary action in other European countries. Based on legal practice and legislation, I state concrete reasons, or establish which grave offences give rise to legal action. Legal action is completed by selling the offender’s individual share of property and their eviction, which is a severe intrusion into their ownership rights, so exclusionary action is a legal instrument intended as a radical measure only where other legal means are no longer available. My thesis compares exclusionary action to alternative options seen as milder legal measures, while still achieving a renewed harmonious cohabitation between tenants in a block of flats.
